Full Version: SOL for Utility Bill

I am new to the board so please excuse me if I'm posting in the wrong section because I couldn't find a place to post this.

Is there a statue of limitation on utility bills in the state of Pennsylvania? From what I tried researching, it states the SOL is 4 years.

A collection agency left a message today and stated they needed someone to call them back, so I did because they didn't say who they were calling for or what it was about. The collection agency stated they were calling to collect a debt on an outstanding electric bill from 1999. I told them I am not delinquent on my electric bill and never was. They stated it was for my husband when he lived at another address. I told the guy at the collection agency that there is a statue of limitation on collecting debt that is 7 years old. He stated the SOL does not pertain to utility bills and the debt needs paid immediately. My husband has never received anything in mail from this collection agency and then out of the blue they get my phone number and called today. Also, we have printed out numerous credit reports throughout the years with the most recent being last month and it wasn't even listed on the report.

I didn't think the collection agency was allowed to speak to me about this is and give all this information regarding my husband's account. I am not on the account and wasn't even with my husband at the time. The guy was extremely rude to me and yelling at me on the phone like it was my debt that was owed so I basically slammed the phone down in his ear.

Utility Bills fall under the UCC SOL 4 years.

Since they called today and spoke to you, they should within five days after the initial communication send you a written notice regarding this debt.

Don't talk on the phone to them again and wait for the letter.

I just wanted to know who they were calling for and what it was about because the message just stated they were calling to collect a debt and someone needed to return the call. He really started screaming at me when I mentioned SOL. So basically I told him I would contact my attorney regarding this matter and slammed the phone down on him.

From what I have been reading regarding the Fair Debt Practices, I may be wrong but the person I spoke to is in violation. My name is not on this account, my husband's name is on it. He told me my husband's social security number, told me the name of the company that was owed the money, the address where the service was and the amount owed on the account. I didn't think they were allowed to give out this information to third parties. How did he know I was actually the wife - he could have called the wrong number and I just happened to call him back.

In most states, spouses are exempt. But knowing CBCS, they probably racked up other violations. Do you have a phone recorder?

Yes, I have a phone recorder but wouldn't I be committing a violation to record someone without their knowledge? CBCS records your conversations with them and they tell you that when you call.

That is fine, when they finish telling you the call is recorded say "My name is Xxxxxx, today's date is ________, and for the record, I'm recording the call also."

Then ask them to clearly state their name, title, company name, company address, telephone number, fax number, and name of the head of the legal dept.

They will most likely hang up! tongue.gif
