During my ex-husband's bout with his addiction to Vicodin (which is WHY he's my EX-husband), he would often go the ER claiming to have a migraine headache so they would give him pain medication. Each time he went, it would generate a co-payment of anywhere from $25 to $125.
When I went to buy a car last year, they pulled my credit report and I was shocked to see that all of these unpaid bills are on MY report. I called the hospital and they claim that, because the benefits were held by me, that I am responsible for the bills.
This doesn't seem right to me - there were visits to the ER after we separated, and I couldn't take him off my benefits until our divorce was final. Is there any way I can have these removed from my CR?
Thanks,
Dawn
Almost all the States have what is called the Doctrine of Necessities or Necessaries, depending on which state you live in.
When it comes to medical expenses each spouse is responsible for other spouse's and childrens medical expenses. It varies from State to State.
My advice is to opt out and get old addresses deleted and then send the medical dispute letter on Whychat's site.
You dispute medical accts this way:
Dear CRA,
My name is xxxxx xxxxxx , my SS # is xxx xx xxxx.
I am sending this dispute certified mail # xxxx to make sure you receive it.
I have no knowledge or records of account # xxxxx on my report # xxxxx.
Please advise me as to the name and address of the medical provider, the date and type of service, and to whom the service was provided.
If you can obtain this information, I also would need the name of the person providing this data, and the manner in which it was provided in order that I may pursue additional legal remedies.
Very truly yours,
xxxxxx
Make sure you HAND ADDRESS the envelope, use personalized stationery and purple or teal font, ( preferably italic)or Handwritten on yellow legal pad with blue ink if you want.
DO NOT send it RR -WAIT FOR THE FULL RESPONSE FROM THE CRA BEFORE CONTINUING WITH THE HIPAA LETTER PROCESS
The dispute letter above is in the link below towards the bottom.
