Okay, I wanted to have my request for a hearing to pay a lesser amount in the mail on Saturday, but a bad stomach virus grounded the family this weekend! mad.gif

I have my papers filled out, with my request to pay $200/month. Do I need to include that amount to show good faith that I will pay it, or will they assign me a 1st Payment Due date if they rule in my favor?

What will happen when they receive my paperwork - my garnishment is set to go into effect on 10/15/06 - will this delay it, or will the garnishment still start?

If they do NOT accept my request for lower payment, will I be given another chance to pay voluntarily? Don't know how I'd do it, but I'd have to find a way, right, if they are going to take the $300/month anyhow.

Can I submit an additional paper with an explanation of extenuating circumstances, such as that my ex is in drug rehab and has no income, so I can't get child support from him, and that I have a roommate now, but in March of next year he is moving to Arizona so I will be on my own with my son, so my bills will go up?

I appreciate any and all help that you provide here!

Thanks,
Dawn

Yes you need to tell them anything that is relevant to your financial situation. You can expect a phone call from them to discuss the situation. And yes, it will stop garnishment once the plan is approved.

Good luck!
