Hello all,

I've been in the credit forum for the last few weeks and I had a question about whether NYSHES was considered a OC or a CA. I posted the question in the other forum but was re-directed over here.

I had a student loan I defaulted on in 2001 from Sallie Mae.

It got transferred to NYS Higher Ed Services. Is this a collection agency?

I got on a payment plan with them, and have PIF in Dec 2005.

I'd like to try and remove them from my reports and i'm trying to think of the best way of going about it.


I pulled this report about a week ago and I noticed they still list on Equifax as an open installment account and i opened the account in 1/1/0001. haha.

Acct Type: Installment
Acct Status: Open
Monthly Payment: $77.00
Date Open: 1/1/0001
Balance: $0.00
Terms:

Payment Status: At least 120 days or more than four payments past due
Comments: PAID COLLECTION

Like I said, I've been reading the heck out of the credit forum. I'll try to come over here more often. So much good info, and only so many hours a day.

Payment Status: At least 120 days or more than four payments past due - violation, since it's PIF
Comments: PAID COLLECTION
STUDENT LOAN

This must be EQ trade line, with the 120 days late. They are notorious for this, but persistence pays off.

You may not get a removal, but guaranty agencies, including NYHESC, are bound by FDCPA as well as FCRA, and have to report correctly.

The above TL is in violation and can be corrected. Federal law mandates their TL cannot be inaccurate or incomplete.

(I did get them to correct mine, fyi. Persistence is the key.)
