Full Version: HIPAA COMLAINT MAILED TODAY!!!

I MAILED THE HIPAA COMPLAINT TODAY TO THE OFFICE FOR MY REGION. LETS SEE IF THE FEDS GET THEIR ATTENTION. UPDATES AS I GET THEM.

I'm still showing a paid medical collection account across the big 3. I sent two letters to the OCR and they refused to investigate and gave this as the reason:

Today, I called the CA (yeah, I know, I'm not supposed to) and asked about the account. They claim that the HC provider transferred payment to them. I doubted the story and they pretty much laughed in my face about it. So I called the HC provider and referenced the letter with the money order, stating that it was payable only to them and not to be transferred, blah, blah, blah. The nice lady said that they instructed the CA to delete months ago and that she will send the instruction again.

Keeping my fingers crossed....

I filed a very serious complaint with the OCR.
They did an onsite investigation, if that is what they want to call it.
The OCR, in my opinion is a toothless agency.
Completely worthless.

AMEN to that VIC!

I had same results w/my OCR complaint. Refused to take it even though the provider provided CA with my ENTIRE BILL THAT CONTAINED EACH & EVERY PROCEDURE done to my daughter. Info was NOT limited to personal info & payment history as they so elequently state in that Q&A previous poster referenced.

Update......

well, OCR was completely worthless....

I called the CA again letting them know that I know that they were instructed to delete the account months ago. The rep said she would look into it. Today......GONE off of all my reports! biggrin.gif So either the HC provider or the CA took care of it!

I'm finally collection free on TU & EX!!!!!!!

well, OCR was completely worthless....

The HIPAA process has also worked for many people, so calling it a joke is really NOT fair. As we all know, there are no guarantees when it comes to credit repair. YMMV.

The letters to the CRA's work fine, but the HIPAA letters to the OC... rofl.gif rofl.gif rofl.gif rofl.gif rofl.gif OC's know HIPAA is toothless.

HIPAA is a joke:

My ex-wife works in my doctors office. She pulled information from my medical records and relayed them to her attorney in order to force me to agree to her terms. Then she later went through the records of a friend of mine, who was in no way connected to the divorce or my ex., and relayed that info to her attorney. Then she got info on the friends daughter and gave that to her attorney.

She never had my signed consent to access my records, due to the fact that I've never trusted her. I contacted the hospital she works for and was told that it was a HIPAA violation and they would check into it. When they got back to me I was told that she had not accessed my medical records. I told them I have copies of the emails she sent to her attorneys. At that point they accused me of mudslinging and said even if she had released the information all they would do would be "re-educate" her in HIPAA. My ex is well versed in HIPAA. She knows exactly what is and isn't allowed. She also goes on the theory "if you don't get caught, you didn't do anything wrong."

I also reported it to the OCR. They just blew it off, too. What good are the laws or the law enforcers if they refuse to protect the victims?

I am under the impression that an intentional or egregious HIPAA violation is legally actionable in civil court. We are told at work (I am not employed in the healthcare industry but do deal with some medical stuff) that to intentionally violate, we are personally liable for any action brought against us by the complainant, and are open to suit.
