Full Version: Please Help - Experian & Rehabbed DOE Loan

My loans rehabbed in March and all but Experian has deleted or removed all negative information. Experian has updated the account to read "Status: Claim filed with government/never late. Account history: Claim filed with the goverment as of May 2006, Creditor's statement "student loan permanently assigned to governement". I've contacted the US Dept of Ed and have been told on numerous occasions that all of the CRA have been instructed to remove the record of default from this account. DOE advised me to dispute this account with experian, however experian sent me a letter telling me that this account has been previously investigated and they will not accept any more disputes for this account. DOE told me that they were never contacted by experian.

Please tell me what I can or should do.

I don't have an answer for you but I am going through the same thing with TU. DH rehabbed his loans a couple of months ago. EX and EQ removed almost a month now. TU has not. I'm going to have DH call the loan guarantor and make sure they submitted the request to all three bureaus. I was also thinking if we should just dispute the accounts and see if it gets removed.

Its amazing how quick they are to put negative info on reports and slow to take it off.

Are you getting the previously investigated or however they word it? EX is notorious for that. How have you been disputing, online or snail mail? Hopefully one of the experts will chime in here.

Yes they are telling me that it has been previously investigated. I've disputed this account via snail mail.

If you rehabbed this loan successfully, then AFAIK, the TL has to be deleted upon completion. I don't think that EX should be reporting it at all. Did your loans have a guarantor?

The reason I ask is because my DH loans defaulted. Sallie Mae placed the statement "claim filed with govt" or however they worded it. The guarantor put the defaulted TL also on his report. I knew at the end of the rehab, the Sallie Mae would not come off, but the guarantor would because that is who DH rehabbed with. And they did come off of EX and EQ at the end of rehab. Only left now on TU. So is it possible that what was left on your report are those TL's that would not be removed. I hope I am making sense and not sounding confusing.

We need one of the experts to chime in here.

The guarantor is US Dept of Ed. and they removed the negative tradelines. Direct Loan updated the tradeline to current without any negative comments. Experian was instructed to do the same however they simply refuse to remove the comments"student loan permanently assigned to the goverment" "Claim filed for insured portion"

I've called DOE several time and each time I am told that these comments should have been removed and that they have not received a dispute from experian since last year! I don't know how else to tackle this problem.

Experts - please chime in.

I read a recent deposition by an EXP employee wherein the employee stated the flag for previously investigated lasts three months. I'm using that to schedule disputes in hopes it lets the prev. investigated TLs slip through.

Get it in writing, then forward it directly to legal counsel, cc it back to the person who wrote the letter for you.

Include a cover letter that states, "If this isn't corrected ASAP, I'll let the courts sort it out." Or, "If you think you've done all you can do to correct this trade line, please advise me the problem is with [the other guy], so that I may proceed with filing complaints in the appropriate venue."

I used the second version and within two days, the TL in dispute was corrected.

It was a different creditor, but the CRA was EXP.
