On Feb 21st, I received a collection letter from NCO Financial Systems

On Feb 22nd, I faxed a copy of WhyChats COLLECTION AGENCY VALIDATION/DISPUTE/CEASE AND DESIST letter. http://whychat.5u.com/ltrcaval.html

On Feb 24th I sent them the letter certified mail. This same day I received copies of a "Health Insurance Claim Form" submitted to Farmers Insurance 12-14-1996 thru 4-07-1997 and another collection letter, This letter said "This is to confirm that we will accept $25,000 as payment in full on the above referenced account, if received by bankwire, Western Union Quick COllect, or express mail, no later than 3-30-2006"

They obviously hadn't received my Certified Mail yet as it had just been mailed.

The return receipt was not filled out with a signature, or showing a "Received by name" but was postmarked back to me on Feb 29th, I received the Return receipt several days later.

I have had no contact with the Collection agency either by phone or letter until today.

NCO as an agent of (Doctors Name), agrees to settle in full above referenced account for $15,000. It is understood that settlement amount must be received in my office no later than 5-30-2006, or the balance in full will become due.

Now what? It seems they ignored my cease and desist. And are pursuing collection regardless. Im sure as any one of you are aware this has brought quite alot of stress into my life, I am greatful of any suggestions you can give me on dealing with this.

Since this debt is 9 years old maybe you should send the SOL letter. IMO since you already send them a C/D you should have no contact with them, you should get a recorder and also document when they call and if you have a caller id take pictures of that because they obviously are in violation. You may also want to search the board for others with similiar situations.

I assume you have opted out and deleted old addresses from your credit reports??

In my opinion, a "faxed" DV is a waste of time, and is on a par with an e-mail or telephone call to these scam CA's.

You should send them the SOL letter, and file a complaint against them for FDCPA violations, ( threatening legal action ), and file a complaint against them with your State AG office as well and the BBB of your State and their home office.

You may be able to file a complaint with your State consumer protection for illegal harrassment and attempted fraudulent extortion, and if you are a senior citizen or disabled you should add that to your complaints.

Im not sure what Opting out means, I have no old addresses on my credit report.

I agree, it is a waste of time, but fax's are free except for a minor telephone charge and I can see no downside of delivering a dispute notice both by fax and certified mail. I would never consider a fax as the only contact method.

I should have sent the SOL letter also, I had planned to but figured I didn't need to.

Would an attorney be able to assist or perform these actions for me? Im tired of the stress this has caused.

definitely do what Whychat says. Also here is a thread about someone in a similiar issue except the calls were coming to work but this person sent a C/D as well.
