A few years ago, I transfered to another school. During this time, a perkins loan from my previous school became due.
The school had my current address and attempted to mail me statements, however I never receieved them. A few months later I got a call from a CA demanding payment plus collection fees. I was young and inexperienced so I paid the collection and went on with my life. Now that I am becoming involved and trying to understand my credit this perkins loan pisses me off even more.
I contacted the school who defaulted me and after some talk they provided the information that they used to get a hold me a few years back. Somehow, through post office forwarding my address was changed when my brother (same last name) moved out. My mail, some of it, received the forwarding request, and so did the school. Now the school has an address that I never lived at. They continued to send statements to his address in a completely different state because of a postal service forwarding requests, which eventually allowed for a default. 'He is a flake and probably different think twice about it.
The school says they legally can do nothing because they didn't make a mistake. Do I have any recourse? I have alredy filed disputes that were declined. I have asked and pleaded nicely, what can I do?
