The back story is that I haven't really been good with paying my sl back(I would pay for a little bit then stop for a time even got a deferment for a year) so it went into default and was reporting neg on my credit. Yes I knew it was in default and just never open the letters they sent. Basicly said to myself I'll take care of the sl when I am done with the other items on my credit reports and other debits i owe.
Then one day at work someone gave me a message to call this long distance number for a jerry. Didn't know who it was and didn't worry about it. Couple of days later cleaning out my purse i found the number and decided to call it to see what it was about. Will Jerry was from DCS and wanted to talk about payment on my defaulted loan. This is when I then set up a payment plan thru them for 12 months. I asked what happens after he replied that direct loan will then have the loan back. He also mention it was a good thing I called that they where going to take action against me, so everything sounded taken taken care of. Wondering what kind of action could be taken I decided to read some of those letter they sent me. Well when I saw the list of what they may do I was glad i set up a payment plan. I really didn't want my wage garnished ( my husband currenty is going thru that for a unpaid judgement, thats a different story).
That brings me up to today which is the day I have found out that our tax refund will be offset for my sl. When I found this out I called the 1800 number they gave my, which was for us department of ed and found out that my sl is still consider in default till my rehab is done and because of this any refund will be offset. I also learned that if my husband wants anything back he will have to file a "injured spouse" claim.
So I have decided to post what happen here in case there are any newbies like me. Do not put off dealing with your Student loans. I know I only lost a large tax refund and so far they didn't do anything more but I wish I knew what I know now
Sorry for the long post, just hope I could help at least one person out with this story.
