I defaulted a student loan that went to US Deptartment of education in 1995. I had made arrangements with them to make monthly payments which I did for several years. A year and half ago I hurt my back on the job which I was not earning any wages except my workmans comp which was not much. I asked to reduce my payments until I got back on my feet which they did. Then the workmans comp insurance company stopped paying my wages and I had to hire an attorney to get straighten out. I explained this to us dept. of education and they was not so nice about it. Which I understand in a way. Anyway my questions they have since turned it over to VAN Ru credit collectors they first ran my credit on 1/3/06 and within a couple of weeks they contacted me. I asked them to send me validation in the form of what payments have been made on this account. They told me that they would mail the next day. Because I was in dispute of the total amount due. They continue to call and I tell them I am waiting for my validation paperwork and until I receive that and review I am not agreeing to anything. I am asking for this because I lost all my paperwork when my home was destroyed in hurricane Katrinia last fall. Sorry about being so long. My questions:
1. How does defaulted student loans laws go as far as being reported on my credit. This has never been listed on my credit.
2. Since this has been longer than the 7 years can this be listed on my credit now.
3. or since this has been turned over to a credit collector now can they list on my credit.
4. I am assuming that they have to abide by the collector laws of my state and if they have violated how to I take this into account. (which they have done by calling on Sundays, before 7 in the morning, and the threats so far.
I plan on paying this off but just want to make sure of the amounts first. Any suggestions on how to handle this would help me a bunch

If you defaulted in 95, it would have been on your credit until sometime in 2002
2. Since this has been longer than the 7 years can this be listed on my credit now.
Only if they file a judgement against you.

I dont believe Van Ru would be calling you before 7am on sunday morning, since according to a collector I know who works there, just told me they are closed most Sundays. The student loan collectors are in Illinois quite frankly, I dont know any CA that calls Sunday mornings. Sunday afternoons and evenings yes, but sunday mornings no.
I plan on paying this off but just want to make sure of the amounts first. Any suggestions on how to handle this would help me a bunch

Thanks for replying to my post, but I keep the message on my answering machine that is time and date stamped. And the calls that I am receiving are coming from Wisconsin. From some of the research I have found on the internet they have quite a few lawsuits because of thier actions.

I had defaulted on my student loans due to a car accident. It was given to several collection agencies through the few years. The last one set up a one year payment plan with me. After I made the 12 consecutive payments they wiped the default status and marked current and transferred the loan back to Sallie Mae. You will probably need to go through a rehabilitaion period. Make sure you get everything in writing.

Collection agencies will not put it in writing since anything in writing would violate the original terms of the prom note. They are not permitted to do that. However, rehab is governed by the HEA.

I also used to recieve calls from Van Ru as early as 8am EST on Sundays (from their Wisconsin office) and I have documentation of this so yes they indeed do call on Sundays.
They have several offices around the US and 1 in Costa Rica.
Best of luck dealing with them, their CRS's seem to actually enjoy the name calling, hostility, lying & so forth.
They used to call my house and identify themselves as the Dept. Of Education or the FBI or tell me they were lawyers (this is not an exaggeration).
I was even called a thief and informed of possible jail time. I could literally go on and on...
You may end up having to contact the ombudsman.

Whoa then management at Van Ru has really changed. I attended more than one student loan conference that management of Van Ru was at years ago. Calling hours was something talked about. Most CA were working the saturday morning/sunday evenings schedule. Sunday mornings, although legal to call, was considered off limits, at least until noon. Collectors cannot call with at least one member of management onsite and no manager I ever knew wanted to haul ass to work early on Sunday morning.
