Full Version: Sallie Mae Bought SL While in BK

I'm not sure what to do. My SL was held by Southwest . I filed Cht 13 in 3/03, and it was discharged 11/05. Southwest sold my loan 11/05 to Sallie Mae.

I made the full monthly payment to Southwest throughout the BK. In Dec 2005, I called Southwest to learn where to send my monthly payment now that they sold the loan (nothing comes in the mail because of the BK status) and was directed to Sallie Mae (SM). SM said my account was in their COLLECTION department, and I was transferred. The woman in collections said that there was no amount due because of the BK status until Jan 2007.

I requested Sallie Mae return the account to repayment status, and sent them a copy of the discharge order that they requested.

A week later, now in January, I called and the account was still in BK status. I was told that they had received my discharge order and my account was in their own processing dept.

I called a week later and received the same message.

Two days ago, I was able to view my account on line (first time since the BK), and learned that they have it showing 955 days delinquent with an overdue balance of $6,001. Today it shows 957 days delinquent!

I called, and got no where with the supervisor of the 800 line, she just kept repeating the account was delinquent. I explained that I would not hang up until I was able to speak with someone else at Sallie Mae. One minute later, I was transferred to someone claiming to be the bankruptcy attorney for SM handling my acct.

She said that just that morning she reviewed my acct, and saw that repayment status had automatically set the account into delinquency with a huge past due balance. She said that she would take my file to her supervisor, and call me back later that day with more information.

I never recieved a call back, or anything in the mail from SM. I was so relieved to talk to someone beyond the front line that I completely forgot to get her name and number.

I don't know what to do. Any advice?

A few more details that completely shock me: The account wasn't even held by SM until 11/05 AND I made all my payments to Southwest during the BK. The last two payments that I made to Southwest (Dec 05 and Jan 06) are even posted on SM's website. Also on SM's own website, is my interest statement for 2005 showing that I paid over $2500 in interest on the account in '05.

What the heck - it's obviously going to kill my credit, when I was hoping that my SL would help me rebuild...

Sallie Mae didnt just by your loan...they bought Southwest Services completely. If you look on the SM website it will show SW services as part of their portfolio.

Give them a day or so to straighten it out. You are probably not the only one affected.

Thank you for taking the time to read and reply. Yes - evidently, it was an accounting error of some sort, and it is straightened out now. It took a long time to find someone at Sallie Mae who could and would help me, but once I did (today) the account was updated immediately.

I'm truly relieved.
