I tried to find the thread where I originally went into all of this, but I cannot seem to find the last one. Anyhow, I am in the last stage of the HIPAA series, got the green card back from the OC today.

Well, this account is 6+ yrs old, due to fall of in 6/06. Many violations, and still on TC as of today. The sent me one threatening letter last month, and today I got this:

(in a big black box): FINAL NOTICE

OUR RECORDS INDICATE THAT THIS ACCOUNT IS COLLECTIBLE- NOW!!!
This is your last opportunity to avoid the action necessary to enforce full payment.

(in a big black box): SEND PAYMENT AT ONCE!

Are they crazy? Am I missing something? This seems pretty confident for a company that is misreporting, out of SOL (didn't even put it on my report until they were out of SOL), and in the process of the HIPAA series. What would your next step be?

It seems an ITS is in order (once the 30 is up with the OC), I cannot imagine they have a leg to stand on.

You say you are in the "last stages" of the HIPAA letter program??

Did you send the medical dispute letter to the CRA BEFORE you sent the HIPAA letter??

As to sending an ITS to a scum scam garbage CA-- why waste your time and postage??

I sent med dispute 11/15 verified.

HIPAA letter to OC 11/29 no response.

First threatening letter from CA 1/6/06.

Sent follow letter to OC and CRA 1/13/06.

Got letter from EQ today saying it was verified.

So, I am now just waiting out the rest of the 30+5 for EQ to complete and OC to do SOMETHING!

I just want to make sure I am the right track. I also called called the insurance carrier and they verified we were covered and that this was never submitted. (used insert cool.gif. Legally, the CA has no standing, am I right?

Yes you are doing everything correctly, however, as you may know from reading other posts on this subject, the HIPAA letter program is VERY slow, and requires patience. The AVERAGE time from start to finish seems to be about 4 Months for deletion.

I'm trying to be patient! It is hard, especially when I know I am in the right. NO, EQ did not send me any info, in fact, all I got was a letter asking if I would like a fraud alert added to my account. That is why I am waiting the whole 30+5 before I do anything.

Although, by that point it will have been 3 months, almost to the day since I began the process.

OK, file a complaint on-line with the FTC against Eq. stating that you properly disputed a MEDICAL account, and requested verification from the REPORTING entity as to the name, address, date of service, and whom the service was provided for.

The Equifax response did not meet the requirements of FACTA, in that they refused to properly investigate or obtain the required verification and are in violation of the FCRA and FACTA for their non responsive reply.

Send a re-dispute to Eq. and include a print out of the filed FTC complaint. cool.gif
