Full Version: What can void a contract?

I would appreciate anyone's expertise.

My brother purchased a new 2005 vehicle from a dealership and did not even bother looking at 2006 models because the salesman said don't even bother because they would be at least $2K more expesive which was not true maybe $500 or less plus the vehicle had been through a hail storm but repaired.

He has took delivery of the vehicle and is more than willing to pay mileage.

He wants to know if the contract can be voided. It was late at night and after he finished all the paperwork they said that oh yeah they had to back date all the paperwork by 3-weeks because of a promotion and instead of 45 days til your payment is due it is now due in 16 days.

Is there any recourse?

What is your brother basing his belief that 2006's are only "$500 or less" more than 2005's? The sticker (MSRP) may only be $500 or less more, but no dealer is going to sell one for only the difference in sticker right now, 2005's get huge discounts at this point in various customer and dealer incentives that do not show up on the sticker price.

Sounds like it may be too late in your case, but this is a good oportunity to remind everyone to extensively research what you're going to buy before you even consider sitting down to talk about money. Find out what you should be paying through sites like Edmunds.com and Carsdirect.com (even consider going through Carsdirect.com to buy the car).

So you are telling me your brother signed a contract and on the day he signed it, the contract was dated 3 weeks in the past?

Against the law to back date contract! The only reason why is the dealer wanted more money... Futhermore it wouldnt have cost your brother 2K more to get an 2006. If I was him I would be on the phone with the lender. Oh and by the way 18 vehicle loans and I never had a payment due in 15 days try 45!!!!! RIP OFF!!!!

dry.gif It's not like I had anything to gain by posting that link, I was merely trying to HELP someone get a good deal on a car. I've never posted on a forum before where helping other members was frowned upon. I guess the only help people can expect here is how to screw their creditors, not how to avoid the situation in the first place with sound financial decisions. rolleyes.gif

I do not investigate whether you had anything to gain or not by posting an outbound link. I merely ask that they be cleared with me first so I can be sure no member is unfairly taken advantage of in their car buying experience. If you read this forum much at all, you will notice that this is normal.

I do take offense to your post regarding the creditor statement and making sound financial decisions.

You would be wise to reign in your temper and your posting style if you wish to continue to post within this forum.

If he bought the car three weeks into 2006, buying a brand new 2005 model that's still on the lot would result in a significant discount, depending on the exact make/model/cost, $2,000 is not unreasonable. As I asked, I'd like to know how the OP's brother is figuring the difference would be only $500, that would be very difficult to believe actually that the discount would be that small, I think they are basing it only on the difference in sticker price.

This is an easy one. You can't back date paperwork on contracts it's against the law.
Simple threatening letter it all you need.

Only problem with that, is if he signed the contract with the wrong date, is they have the only proof. Anything on the contract he signed is assumed to be the way that was agreed to. The burden of proof will be on the buyer. Things like this should serve as a warning to all. If it is on the contract, you are locked into it. If it is verbal, it most likely didn't happen/isn't going to happen.
