I decided to call TG since I know what my balance should be and I was considering doing a pay off with the performance bonus I got.

When I finally got to a live body I found out that my balance was higher than it was when my garnishment started. My employer has not sent one red cent to them.

I can't call the line here at work until my break, but rest assured that I am going to rip someone apart. It's bad enough that I screwed up, but to find out that the money that has been taken out isn't going where it's supposed to infuriates me; even more so since I got a letter this weekend that told me that they will start charging a flat fee to take the money from my pay check.

You might want to look the the guide for regulations. Also, I dont think they can charge you a fee for garnishment.

And of course I can't get a live body at the garnishment number.

I am LIVID!!

I called TG back to get more info and it appears my employer hasn't even responded to the garnishment order, yet I see the money out of my pay checks.

And unfortunately I live in a state where they can charge a fee.

Yesterday I managed to contact the garnishment line and I explained the issue.

Tonight, I called to check on it only to be told that I should have reicieved a phone call and the person handling it was out of the office for the day.

I then called TG thinking they would have info. No, they have no record of my employer getting in contact with them. They asked who my employer was and when I told them I was advised that there was never a problem with this company getting the money to them and if it continued, I needed to contact the labor board.

I'm honestly at the point of just putting the *&(&#%^&%*@ loan in toto onto my AMEX card and pay it that way, then with the refund I get from the SL, pay AMEX down.

I am so not a happy camper in credit land tonight

If they accept credit cards (and a lot of guarantee agencies dont) you might be able to save yourself some money. Ask for a settlement. They will write off some off the collection fees and possibly interest. However you will get a 1099 for the write off portion.

Lynn, this is all over $736.

I'm just on the verge of tears right now. So frustrated and fed up with the whole thing.

Well, yes, do it!!!! I don't see what the question would be between a screwy bureaucratic system and an unsecured lower interest CC. Go for it ASAP.

It's a moot point. TG is in the dark ages of computing and will not take a credit card.

AmEx will send you a BT check. Look on their website and see if you can order checks from there, before you call.

Get a BT check and pay it off if you can do that and THEN go after your company for the money they took from your check!

It has nothing to do with being in the dark ages. At a FFELP loan conference I attended, most FFELP guarantors had decided no to use credit cards as a payment method as they felt it traded one mistake for another. Some of the credit card companies where also balking at having defaults charged to their cards and then having those charges defaulted on or filed in BK.

Sounds like lip service in regard to "trading one mistake for another". That's nice of them to be helping everyone out. Rather, its a command from the General Counsel, who went to law school with the General Counsel of the credit card issuer - DO NOT TAKE CREDIT CARDS because then the borrower will bankrupt the card and hurt my buddy in the CC industry! There is your RICO claim that someone was talking about a month back.

I finally got in contact with the person in the Garnishment department.

The checks were sent, but never cashed. So this morning they stopped payment on the previous two and sent a new one with both payments on it. They also let me know that they keep track of the amount paid and amount due and when they match they send an additional letter to TG to let them know its paid and to take the writ off. In addition, they send payment every pay period, so February 15th, TG will owe me a refund. I will wait one week after that to file my income tax, which I'm using for the last big thing on my reports.

Maybe all is not lost, but I am still trying to figure this out. And I still want to beat my head against the wall until I can't think.

Even waiting a week may still result in your tax return being sent to TGSLP. They will forward it to you but it will be delayed. The guarantors do NOT regularly update the IRS once the lists have been submitted .

I plan to call them DAILY after I get it paid off.

I've already calculated what I should get back, and I am using it to either pay off or PFD (goal) my last big baddie. So getting this done is critical.

And trust me, TG will be tired of me until I know for 100% sure and certian that its right and the IRS isn't going to take my money. TG's loosing the payments has put me into the refund being taken and I plan to make their life miserable if that's what it takes.

And I asked how long it would take if they got it....I was told 4-6 weeks!!! Not an option.

Wont do you any good. If they do, they will do it on their timetable.

Texas will not PFD. Wont happen

Is there any proof that TX lost the payments?? Or the postal system??Only the CSR's will be sick of you. They have nothing to do with revenue recapture. Calling repeatedly and making an obvious nuisance of yourself will only delay it. The revenue recapture money comes to them via electronic transfer. They have to then cut and mail you a check. Manual function. It takes time. Do you want to go to the bottom of the pile??

And they will also charge you a fee for the privelege too! Lets face it....you werent paying your loan voluntarily. They had to garnish you. You will have to be patient.

I'm trying to be patient, but the first CSR when I tried to make payment lied to me. And every one I've talked to since have treated me like an embicile other than the lady in the garnishment office.

And as far as not making payments. I had a garnishment, then the money stopped being taken out of my check. I assumed it was paid off. I don't know why that company stopped taking it out, but they did. So my natural reaction was to think it was over and done with. That was two years ago and my former employer who I was with for four years as a consultant where I'm now employed. Would you have made this assumption? I got my tax refunds for the past two years with no problems at all.

I asked my employer about the lost payment. Several other checks were sent on the same pay periods, and apparently all of them were cashed. Somehow I was special and was missed. And in the process was charged more interest on money that should have been paid. Ask me if I'm bitter, because I assure you that I am.

As far as the PFD, that's for something totally unrelated, and this whole SL thing falls off my record in March.

IMHO and from talking in my AWG days to staff at TGSLP, they are bunch of idiots. The CSR probably didnt lie...she probably didnt know any better. They were always giving out bad information. Clueless bunch of idiots!
