Full Version: Can a CA do this???

I recently had a CA supervisor tell me that my husband was not allowed to participate in our calls when we were negotiating payment arrangements. I had made it a conference call with his cell phone, my cell phone, and the CA's #. Does this hold any water? I thought the problem would be the other way, if they had someone on a call and didn't tell me or get my permission.

This is a crazy world we live in!

A CSR at a guaranty agency did the same thing to my BF a couple of weeks ago. We had her on speaker phone because I was feeding him the words to say to negotiate a rehabilitation agreement on his loans (thanks to my CB knowledge!)- she refused to speak to him with me on speaker.

I just had to zip my lip. It was hard, believe me...

I'm not too sure about the conference call though- that probably would really freak them out- they never really know who's on the other line. Plus, it's *supposed* to be strictly between you and the creditor when negotiating payments. If you would really like your husband to hear the conversation, I would recommend what we did- speaker phone. It helped get the agreement we wanted- I just wrote out what to say to them instead of letting my voice be heard. It worked. good.gif

Thanks, Jeslyn. That's a good suggestion, although we only have cell phones and the speaker phones on them are a little lame. But it's better than not having him hear what's going on. But I'd still like to know what my/our rights are with regard to this, if anyone knows, or can point me to a website with statutes, etc. We live in Virginia.

This is a crock! The CA can discuss your loan with anyone you give authorization to. Some do require that the authorization be in writing, others verbal. Just fax it. There is nothing in fed regs or FDCPA prohibiting this!
