If it is ONLY $1,600, than why not pay it? Bankruptcy - in the first post. I was pointing out that it is absurd to label any amount as "ONLY" X amount. The amount is insignificant because it is not OP loss. I'm not judging OP (my first comment was that I can't blame a company for being a bit pissy if someone includes them in BK anymore than I can blame someone for having to file for BK), just that labeling the amount as only $x is silly. You are an salamander. -

I am sure anyone who has filed BK knows, I just want to finally get this over as this has been an albatross for 4 years. Getting a discharge and closing all closing unnecessary accounts will be needed before I can be truly free again. -

If the debt was BK debt than they shouldn't neither should NFCU. My point was that at no time, even during the PRE-BK period were the 2 largest creditors a PITA. By comparison, PNC was owed $7000 and they weren't too bad and even sent some great settlement offers, offering me to pay as low as 25%-33% of the debt and they were never nasty, although the callers from India(collectors)were annoying. -

For comparison, I owed Chase (originally Providian/Wamu) about $14,000(the largest debt) and they never gave me a hard time whatsoever. Bank of America(FIA) was owed $12,000 and they also were no trouble. The smaller debts got me suited and garnished. Go figure. The worst have been NFCU and another CU. -

If it is ONLY $1,600, than why not pay it? All debts have to be included in a bankruptcy and there is no reason to favor them and pay them off. The only reason would be so that they would give credit in the future, which I couldn't care less about. -

I forgot to mention I only owe them $1600. -
I cant believe I bought into to the hype about NFCU being almost heavenly as far as creditors go.This forum is filled with such high praise for them. Here is my experience. I just filed Chapter 7 11 weeks ago. While in my lawyers office it took me 1 hour on the phone to get them to fax over a document showing that my total balance was zero in my savings and checking acct. They just dragged their heels all the way. Less than 2 weeks after filing I got a collection letter from them. Of course I was supposed to believe they just needed more time to realize I had filed Chapter 7. Well 4 weeks later, I got another letter attempting to collect on my "past due" credit card. My lawyer sent them a "nasty letter" a few days later. Well 4 weeks later,I got a third collection letter from them. This is 11 weeks past my filing date and about 7 weeks since my 341 hearing. Apparently they do not have to follow the law. On top of that they have made it so difficult to have my checking/savings accts closed. I have to call, be transferred, leave messages, get disconnected, call back, be tranferred, etc. They would not provide a direct number to the department I needed to talk to to close my account. I just got off the phone with them and the lady was nastier than anyone I ever spoke to at Bank Of America, Citi, Chase, etc. I wanted to choke that beyotch. NFCU SUCKS!

Just thought I would share this article for the benefit of those on this forum who a year ago would not accept how common "strategic default" was and that this is a big reason why housing is in the disasterous mess it's in now. http://www.nytimes.com/2010/06/01/business...?pagewanted=all The comments section is very interesting as well. Then again, this article will not likely cause some know-it-alls here on CB to recant past ignorant statements.
