  5. So if they purchased in 2013 and decide to file suit in 2015 this bill doesn't apply? (Portfolio has 3 alleged accounts of mine, one they've already filed suit on)
  6. I am wondering what is considered validation under this new California Law? Portfolio sent me a letter stating they bought the debt from Cap1, with my Name, last 4 of SSN, Date account opened, balance at date they bought it, interest or last payment to PRA and total balance. Is this in compliance with the new California law? Or are they supposed to send a copy of the CC statement? Is it enough that they have the full account number and the above info on this validation letter? Thank you.
  7. Dredging up an old thread. Think there's a backdoor in to Cap1. I currently have an unpaid CO with them. Was added as an AU to wife's quicksilver a few months back. Applied yesterday and was approved for a 300 CL with FICO's in the 550-580 range. I do have a clean mortgage and two clean auto loans though.
  8. I've yet to find out why they pulled. It could be a zombie debt. I'll wait for some mail. They can't put anything on my report legally until I've had notice for 30 days due to the Rosenthal FDCPA in California.
  9. Over three years after start of repair, got the car, 5k CL's and the mortgage, thought all was good until this morning when I see a hard pull from L3gal Asset Fincl. Group on my EX file. Anybody dealt with them? I googled the address, it matches a CA that got smacked by the FTC almost exactly a year ago. Have they reincarnated into this new CA? Are they zombie debt guys or did I seriously completely miss paying a bill recently? Any info would be great TIA
  10. Crap1 finally folded. I think it was the CFPB complaint that did it. Nothing I sent seemed to work, the exec kept sending me letters that basically told me they didn't care if there was a judgment, they were still going to report. Friday, I pulled all three reports backdoor and Crap1 was gone. Haven't been able to confirm what worked, but I know it wasn't my disputes to the bureaus, they verified both times. Anyway, we won!
  11. Having trouble getting an attorney to respond. Anybody have a recommendation for a consumer attorney in Southern/Central California?

  13. Update- Cap1 has been sent two disputes, the second being an ITS. They hold firm that money is owed, even after receiving dismissal orders and being informed they are in contempt. CRA's have verified twice and also been sent ITS letters. We're going to court!
  14. Did not PIF, left 150 reporting of the original 400 limit. Just logged in and they gave me a 400 CLI to 800.
  15. Do you happen to be a California resident? If so the California Rosenthal FDCPA prohibits debt collectors from reporting collections to the CRA's until they've notified you by mail and given you thirty days. Otherwise, is the collection out of your state's SOL? If it is, inform your loan officer of the collection and ask him if writing a good LOE would be okay. In my case I got an FHA loan with several medical collections on my reports.
