How to dispute this UNPAID out of SOL charge off?
jcredit115 replied to maverick9's topic in Credit Forum
I'm more/less in the same situation here, almost with the exact same timing! I've disputed incorrect names, addresses, etc and I'm waiting to hear back. Problem is, my OC is in California, while I'm in a state with an SOL of 6 years for CC debt. I don't have my original paperwork either, so I'm not sure which state takes precedence. I did call the OC (a credit union) a while back and they stated it had been more than 4 years, so the SOL is up. Any thoughts on whether or not I should go ahead with a validation letter to all three bureaus? MY thought based on what I have read up to this point is to now proceed with debt validation letters. -

I’m now disputing the incorrect name spellings and header information, which appears to be the first step. I also opted out last night, so that’s done as well. I’m following WhyChat’s guide to address all late payments and the CO. Thanks for everyones help thus far. -

Well, this type of response doesn't exactly help me at all. I received my last report today from Innovis, which does not even list the account noted above from the CU. However, there are other lates on there from old closed accounts. Can someone please provide a link to a dispute process guide? I have read WhyChat's, but not exactly sure which approach to take. I am going to dispute the name mis-spellings and such on each report, but that's not the case on every one of them. Also, if I dispute the CU report with the CU and it gets deleted, will the CU be able to just report it again the next month and it will re-appear? -

Only issue I'm having is verifying when I paid vs what they have reported. These delinquencies are 5 years old and I don't feel confident that I have accurate records vs what they have. Thoughts on a good approach? I'll start with good will letters to remove some of the other lates, even on the closed accounts and the accounts that have been current for a few year, but remain open with balances. I don't feel as though the lates are hurting my credit as much since I haven't had a late payment in the last 3 years, although I still would like to get rid of them. The biggie on my report is the CU account repeatedly showing the CO and balance. I have talked to the original creditor and didn't get anywhere, they actually said the SOL in California is 4 years, this is 5 years old now - it drops off in June of 2022. -

Ok, so I have received and reviewed all three credit reports from TU, EQ and EX... still waiting on Innovis. The one specific account in question is reporting the same information across all three CB's. While the information is somewhat different in what is actually reported (some have more than others), the common information is the same on all three reports. Thoughts on next steps? If all of the information appears to be consistent, then what would be the preferred approach? There are also some old 30 and 60 day lates from closed accounts and one remaining open account, but nothing within the last three years. There are mis-spellings on my report related to employment and such. My length of credit is approx 25 years. Appreciate any advice. -

I have not initiated any disputes up to this point. I only ordered the three reports, printed them out and compared the account data. Reading the dispute guides now and will draft letters for those. -

I ordered them online and downloaded them as PDF’s. Went to annual credit report to obtain all three. I printed them out last nights and noted the balance, payment status by month, etc and it all matched. you are correct that there are differences ok’ing the three reports, but the information noted was the same from what I could tell. -

I got my reports from the big three... who is the fourth bureau??? I have TU, Equifax and Experian. the tradelines for this particular account are EXACTLY the same across all three bureaus. Almost looks like a cut and past job since they are so similar. -

Got it and thank you. I'll start that process now. One more question... I had lates prior to 2015... would those be considered "date of first delinquent"? There was a "good" payment month scattered here and there, but if the first missed payment would be considered DOFD, then I may be at the 7 year mark. -

Thanks for the replies. So, if they are going to continue to report every month for the next two years, then would it make the most sense to pay it off, settle, or ride it out? Just trying to understand the impact on my score given the three scenarios above. -

That's what's showing on my Experian report., I have not seen paper copies of the other two, but thinking they are the same, as they are reporting to all three with consistent information. Three scores are approximately the same too. -

Thanks for the information. So, that said... is there anything I can do? From the sounds of things... I'm at the 7 year mark as of Sept 2022... which is another two years away. I really would like to clean this up prior to that date, as I don't want it to continue to haunt for two more years. The CU will only mark as "paid in full" or "settled" if I just pay them. I'm not sure that's the best route to take. Thoughts? -

Sorry... but assuming this is date of first deliquent? If so, August of 2015 was my last good payment/report, negative since. They are showing 51 CO's on my report.
