This has nothing to do with when the account happens. It limits the reporting of paid/settled medical collections to 45 days. The reporting happens whenever someone pulls a report.

Hopefully it will pass the senate version in a lame duck session in November and be signed into law before the end of the year. Great. So first I get another "verified" from EQ in response to my FTC complaint (previous post), and now I just received a letter from the OC's attorney stating that they have investigated my complaint (Hippa OC letter) and that they did not violate HIPAA. They also sent me a copy of all account notes. It shows that we contacted them repeatedly about this account and informed them that we called the insurance company multiple times and was told the claim is being processed. The notes show that they (OC billing) also called the insurance company and was told the same thing (claim being processed). Despite that, they sent the claim to collection agency without warning. If anyone has any ideas on what else I can do I would love to hear it. Thanks -

BubbaG, thank you for the info. Yes, and I think what a consumer considers reasonable is going to change a lot in the next 6-12 months. Just like when we thought gas prices of $2.15 were reasonable, now we think $2.75 is reasonable, since they were at $4.00 a year ago. The times, they are a changin'. I don't think in the long run we will see too big a change from the past. We need to wait and see how consumers respond to the changes in credit terms. I think CC consumption is much more elastic than fuel consumption. I assume most creditworthy consumers will either PIF or stop using credit since they understand how much more it is costing them. That leaves the CC companies with a smaller pool of more risky consumers paying higher interest rates. That is not where CC companies want to be. -
I do not believe this is correct. People here told me it is OK for the OC to try to collect at the same time as the CA. Just FYI.

Yes, it is only on Eq. The dispute with ftc complaint has not been delivered yet, but I am very pessimistic given that they verified twice within 48 hours of receipt of the dispute. Thanks WhyChat. -

Quick Recap: Full bill sent to CA after insurance delays. At the same time the insurance got straightened up and I got a bill for the EOMB, much less than the full bill. Paid immediately to Dr office. On credit report the collection account shows the full bill amount as PAID. The full bill was never paid, the amount paid was equivalant to EOMB. THIS IS DEFINITELY WRONG. Sent prehipaa dispute to CRA, came back verified with additional info from the CA (adjusted the date) Sent hipaa DV to CA, no response. (may not have received the letter) Sent Followup dispute with ARRA language, came back immediately as verified, removed "consumer disputes this accout" Filed FTC complaints and sent with followup dispute to CRA, waiting delivery. Send hipaa nastigram to Dr office with insert B. Got a call from them, they said they have talked to the billing company and they are sure there is no hipaa violation and they can do that. They say insurance delay was my fault even though it was the result of the billing company filing wrong info in the claim. What to do next? -
No credit pulls from these guys up to two weeks ago (I have recent reports, need to learn about the backdoor thing). I will wait and see what happens next. It doesn't sound like this was a standard CA behavior. Thanks guys

Today there was a VM left on my landline saying, "hi this is a message for" Followed by about 2 seconds of silence, followed by a hang up. Caller ID showed unknown. When I googled it very little came up. Called back (after hours) got the name off of the automated message and googled it. It is a CA. Is leaving a lame message with no recipient name a tactic these guys are using now? By the way, I have NO CLUE what it could be about. What should I do?

Ok i just looked around for info about this, here is what I found in one site: "This bill is in the first step in the legislative process. Introduced bills and resolutions first go to committees that deliberate, investigate, and revise them before they go to general debate. The majority of bills and resolutions never make it out of committee."

Dear god! When is this up for vote? It probably be at least a year before it takes affect or is that too optimistic?

Did you record this conversation? Without proof that conversation never happened and you can't do anything about it. He will likely call again, this time make sure you are prepared.
