Came back at 5.49%, so i locked it up. Could have shaved another .25% with auto payment, but don't have any accounts with Chase other than a CC. The truck is a 2008 Silverado Crew Cab LTZ with clean NADA value around 30k. Purchase price was 23k.

No lien of any kind can be found at the courthouse. An interesting saga because the bill stemmed from an on-the-job injury in 2002.   3. Quick question: If the CA is the one reporting a public record to the CRA's, what happens when they sell the debt to another party? Are they legally allowed to sell the debt and subsequently report this bs? On that note, has anyone ever worked with a CA who filed suit in an attempt to have them stop reporting to the CRA's? This is becoming a nightmare to handle!
  4. Thought i would subscribe to this thread as well, because Ray and myself are in the same situation. Tonight, i plan on drafting a complaint to the FTC for EQ and EX. In my case, the collections agency is supplying the info, and the CRA's are just verifying through the CA. I have no recorded judgments in my name at the courthouse listed on my CR's, only a case file with an entered judgment.
  5. Wow Ray, sorry to hear that the complaints with the FTC and others did nothing. I've been following your issue as mine is similar. Did you actually receive anything from the CRA on this last round? Also, who is reporting this info on your report? Some collection agency?

  7. Thanks George, i think i will write a PP. I didn't expect the hard-pull to hurt my credit much if any, it was just the principle of the matter. What should i expect in return from sending out the PP letter? I'll go ahead and search for a template.
  8. Yes, they did validate. They sent the original charts from the ER with the ambulance fee. I never saw any proof that they now own the debt though. I'm assuming they do or they wouldn't have access to the ER information??
  9. That is what is a little off about the situation. If they were a CA and authorized to collect on a debt, why pull the report under the false pretense of my renting an apartment. I'll have to double check the exact address when i get home to match everything up. I do know that the City and Street Name were identical. A little too ironic if you ask me, considering i have never lived nor conducted business in Engelwood, CO.
  10. This is a bizarre situation. Maybe you guys can help me out. A company trying to collect a debt is based out of Engelwood, CO. I've just sent a DV out to them a while back so i remember their address. I just pulled my TU to have a look and noticed a hard-pull inquiry from "Park at Westcreek" for tenant screening. Hmmm...I live in TX, and to my knowledge, i don't have any clones running around trying to rent apartments. Then i notice the address is ENGELWOOD, CO. The same street as this law firm trying to now collect a debt. This must have been how they saw the collection (which is now gone from CRA). The date they pulled was 07/03/2008. I received a letter in June of this year from the law firm trying to collect on this old debt. Anyone ever heard of this type of thing? That's a pretty sleazeball thing to do, faking an apartment application to get someone's credit report. This should be a mega-violation of the law as it's basically forgery in my view. Anyone know of any recourse against this CA for obtaining my credit report without permission?
  11. There is a journal entry of the judgement in the court database. It states that "Credit Bureau Services Assoc." is entitled to its costs. The total is just over $1,000. However, there is no record online of this judgment being transferred. I'm not sure if it would be entered into the docket when it is transferred to another party for collection. The law firm in CO is now attempting to collect for half price, but i'm just not sure if they are authorized to collect. Since they have validated the debt (although didn't show they now owned the debt), would it be wise to draft a settlement letter stating that i will pay the half-price as noted in their previous correspondence with the stipulation that they are to vacate the judgment after receiving payment? Also, they didn't send anything about the judgment when validating, only the original ER bill and OC documents. Can they (the CA) actually vacate the judgment? At the very least, i would want a confirmation letter from them that the judgment is satisfied "paid in full". Does this sound like the best course of action considering the details?
  12. Hi all, figured i'd send an update on my initial step to resolve this medical issue and get everyone's take. I sent the debt validation letter to the debt collector/lawyer and have received validation today. However, there was no proof sent by the law office that they have a right to collect this debt. The only documents sent are the ambulance record and medical charts. After looking the documents over, this was from a worker's compensation claim and should have been resolved by my old employer. Apparently not. A default judgment was awarded on this debt in 2006. The original date of service was Apr 2002. Does anyone know how to determine if this law firm is authorized to collect this debt? Also, will paying the law firm half of the original amount owed (as stated in their original dunning letter) settle this judgment?
  13. **Update** I've checked the court dockets and the judgement was filed on 06/27/2003 and was disposed as a default judgement on 12/14/2006, it is on my public record. You can see where they tried to serve a couple of times and failed, then the lawyer successfully served an "alias summons" a few months after failing to serve the prior times (It's hard to serve me in OK when i live in TX). I'm not quite sure what an "alias summons" is or how it happened. There is no documented assignment of this judgement to any other 3rd party in the case file. Just before i read Why Chat's post, i mailed out a Verification letter to the new law firm. There is no way the 3rd party can file suit if they don't collect anything from me is there? If that was the case, you could have suit filed for the same incident several times over it would seem. Assuming the worst-case (motion to vacate denied), what is the best way to pay this judgement if required to do so? Ignore this new 3rd party? Any possible way to have the OC or the OC's original lawyer vacate this judgement? Should i pay the judgement through the court?
  14. I guess i could try, but then again the courthouse the judgement is filed in is 8 hrs. away. I'm not sure if i would have enough free time to pursuit it 100%. I will look into filing a motion to vacate this judgement, but i also need a back up on how to take care of the issue at hand in case the judge denies the motion. For the Back-up plan (assuming vacating fails): The problem is that now a third party (law firm) is involved. Here is a portion of the statement: "It is our goal to help you resolve this account in a voluntary fashion. With this in mind, we have been authorized by our client to offer you substantial savings to resolve your account. We will accept a lump sum payoff of $572.81." If i paid the law firm the amount they asked, would the judgement be considered satisfied by all parties? Would the status be updated on my CR showing it as "paid"? Or will i get another letter from another law firm 8 years later that says i owe these guys something again? Again, would it be wise to send a DV letter to this law firm in order to be positive that this is for the judgement and they are in fact authorized to collect for the OC?
  15. Yeah, i had moved in 2005 and apparently they couldn't physically serve me at all. They used some kind of alias serve in order to push it through to file the default judgement. I found it on the online court docket search.
