Just a word to the wise here - even if that penguin image is royalty free, MOST of the royalty free graphics sites specifically state in their terms of use that the images can NOT be used as logos - so you might want to check into that before you use such an image . We get asked to do logos all the time for our web site clients, so we run into this all the time. -

The requirement is that they report it as 'included in bankruptcy', there is no legal requirement in the FCRA that they report it specifically as 'discharged'. As for reporting the DOLA, that date is not required per the FCRA but the date of first delinquency IS mandated by law to be reported, and that's the date that begins the reporting period. You say they're obsolete - were these accounts delinquent as of 2000-2001 ?? -
This needs some clarification: Unfortunately, that is not correct. The expiration of the SOL is NOT a bar to a lawsuit in SC (or any state except WI, MS and CA), so it is NOT illegal, under SC law, for them to sue you on an out of statute debt. It is also not illegal for them to attempt to collect. The expired SOL is an AFFIRMATIVE DEFENSE which is at your disposal should you be sued and you use it in court to get a lawsuit thrown out. There is no doubt whatsoever that this so-called 'collection manager' is a mental midget regarding the Federal laws regarding reporting. I'd love to sink MY teeth into such a moron, but if you're going to fight this battle, you need to be the one with 100% accuracy in your assertions. I'd answer the twit's letter, she can't stop you from mailing and her assertion that she can keep the debt on your reports indefinitely is ammo for you !

I'd like to know what 'law' they think says they cannot remove inquiries. Next time they say that, ask them to quote the statute.. .... waiting.... waiting... you'll never get it because there is no such law !

It's horsehockey !! There can be no 'docket number' unless they've actually already FILED a lawsuit and it has been scheduled on the judge's docket. It's a scare tactic and the number is nothing more than their INTERNAL reference number for your file. -
Not on a discharged debt they can't !!!!! ANY negative reporting or collection activity on a discharged debt is a violation of the permanent injunction of the discharge. The CA has NO BUSINESS putting ANYTHING on Stormy's reports on a discharged debt. Stormy, you need to go after them with a vengence and you need to nail them for CONTEMPT in Banruptcy Court - that wields a LOT more clout than the FCRA violations !!

Do we not have to be careful here ?? While I agree with what IDare has highlighted, a possible gotcha here is that this was a SEARS CARD - easily defined as a 'store card', you couldn't use it anywhere else. This may not work well for a non-store type generic Visa or MasterCard, although I agree that it SHOULD, people may need to be VERY careful and not just ASSUME it's going to cover EVERY credit card. Those people with Best Buy, Circuit City, furniture store cards, etc. could definitely use this. Palisades was also, apparently, relying on it's usual 'account stated' phoney affidavits and the credit application alone, which the court clearly says isn't enough to prove liability hence throwing the whole thing into the 'oral contract' arena. I think this is FANTASTIC and the guy won it PRO SE, but I don't think it should be seen as a panacea for EVERY credit card case in FL - not yet anyway.

My debit card does have a VISA logo on it and can be rung up as 'credit' but the car rental agnecie's issues seems to be that because a debit card is linked to a bank account with a balance that could be exhausted by your use of it - and theirs - then they have no 'protection'. With a credit card they could use up your entire available credit, even push over the limit, and they would STILL get paid no matter what. I have found that Budget WILL rent you a car with a debit card (except for certain locations posted on their site) but they will put a $300 hold on the account. Once you turn in the car, they subtract the rental amount from that $300 and then credit you the remainder. I don't necessarily have any problem with this, at least I can get a car and not have to worry about shelling out unexpected cash to make sure my own car won't break down on me it I couldn't get a rental. I HATE this system. I made a reservation this morning on-line. I'll be calling Budget at the airport to confirm they'll take a debit card. Geez...

Ok.. I am going to call the local Enterprise places, there are 3 here that I can check out. I'll never get a secured/pre-paid credit card in time and I absolutely refuse to deal with Household/Orchard Bank. My Ex had SO much trouble with those people it was insane. At one point he called to ADD money to his card, to boost the 'limit" to $1500 from the $500 he started with and they gave him a hard time ! I mean, he was GIVING them money and they gave him grief.. unreal. I just despise Household and will not deal with them. When I'm ready, I'll find some other secured card to go with. As for 'other' credit cards - I don't have any. Well.. I do have 2 gas cards and a Sears card that rode thru the BK because they were zero balances and they didn't close the accounts. All 3, I believe, are backed by Citibank. I've been using both cards regularly and Sears once for my auto club, all are perfect pay. I may end up having to use my own car, which may cost me a bunch if anything nasty turns up when they check it out. Thanks all !

Thanks everyone Enterprise web site says you can't rent on line with a debit card but that SOME offices may do it anway. I don't care about a hold, I've got plenty of money in the bank and I'm only going to be gone for a weekend. Even a $100 cash deposit is easy enough to do. Wouldn't do Dollar if they're going to ding my credit for a stinking car. They see last year's bankruptcy and probably put up the "NO F*in WAY" sign. I've been happy enough paying cash for everything for the last 4 years so this last year since the BK has been no big deal and I rather like not having any credit card debt. It galls me that you have to be a slave to the credit card industry just to rent a freakin' car. This is the ONLY reason I would even consider getting any credit cards any more. I rent so infrequently these days that it hardly matters. The reason I haven't bothered to even apply for any credit since last year is that I truly loathe the idea, but I know this FUBAR system of ours will force me to do it - eventually. I can't believe you can't even pay CASH

Ok, this is NOT a credit question, not exactly. Does anyone know which, if any, car rental companies will let you RENT a car with a debit card ? All of them will let you PAY for a rental with a debit card, but I know that Hertz, Avis and National will not let you PICK UP/Rent a car w/o a major credit card --which I do not have and do not have time to go through the hassle of trying to get one before 5/11/06. I don't trust my car to make the drive to MO next month, so renting a car for a weekend would give me some peace of mind for the 8 hour drive up there. TIA !
