I don't know what she can do to cover herself other than DV/LC&D and advise them of the other 4 CA's w/o any validation ever rec'd. Is there anything I'm missing?

Okey-dokey! I'll tell her to send a short, sweet DV/LC&D including the fact that they are the 4th CA to come out of the woodwork on this, disputed each time, no validation ever received, etc. Send CMRRR and see what happens. They really don't need to use scare tactics. The name Hanna is enough to bring out the valium from what I've read. Thanks RadioRob! I didn't know what to tell her. The dog ate my Hanna to English dictionary.

Recently I posted for info about this notorious CA/Attny as my dear friend rec'd some calls and was frightened by their reputation. I've never dealt w/ them, personally, but lots of you kindly posted a reply. Well, she received a dunning letter. It, of course, says that they represent XYZ Bank in their effort to collect-----Please contact us to make payment arrangements. Then they devote a paragraph to the 30-day notice. They close with this statement: "At this time, no attorney with this firm has personally reviewed the particular circumstances of your account. However, if you fail to contact this office, our client may consider additional remedies to recover the balance due." Her initial thought was, "well, duuuhh!!".Then she thought about it for a minute. Neither of us have seen a similar statement in any other dunning letter. Is there some reason this was included that we are missing? Some deeper meaning? I have to think that the English translation is something other than what is stated.

BTW, Roswell Rd. address still good for FJH? I read a post on Hibbs from someone in that area that said they are now going by Georgia Receiveables located on Kingston Ct, S.E. and Roswell office is empty!?!?! FJH website still lists Roswell. I think she should send her letter to Roswell. Thoughts? Never mind. That was a REALLY DUMB QUESTION. Went to the FJH website. (Well, Duh!) -

Hi, Jen! Thanks for the hand holding on this one. It's REALLY appreciated!!! Any thoughts on which side of the barrel she's fallen? Sounds like typical collector side to me, but I've never dealt with the suing side of any CA, yet, so I don't know exactly what the suing side sounds like. -

Yesterday (Monday) she ran out to get to the post office before it closed....only to have a dead battery! By the time that was resolved the PO was closed so she planned on mailing her letter today. While she was dealing with the battery, she rec'd 2 more calls, again on her cellphone. The first left no message. The second, which she rec'd about an hour later, left a message, which essentially said this is a message for "her name" if you are not... hang up or disconnect....this is Ann Lyons with the Law Offices of "FJH"... call back 800#, ext. xxxxx.... attempt to collect a debt. It sounded like a real voice. Based on this new development, she thinks she needs to rework Jen's DV just a bit, keeping it short and simple, and get it out today. It remains to be seen if Hanna complies w/ the 5-day rule. So far, I can't tell if this is the suing side or the typical collector side of FJH as bostonte explained in the first response to my OP... My poor friend is on her last nerve..... Again, THANK YOU for the help! FJH even has me unnerved, and it's not even my debt! -

Hi, snark! We've been reading and reading. And believe you me, "careful" is the word for the day. Our county court has a GREAT website. Looks like Hanna and his various goons have worn out their welcome in our courts. Almost no activity in the last few years. Judges have only so much patience for unsubstantiated, bogus suits. On another note, my friend hasn't received any more calls and still nothing in the mail. Hmmmm..... Strange that they would call her cell phone once, leave no message and then nothing....so far. Aren't they like terriers with a bone? Once they get their teeth into you, they don't let go??? -

Hanna is licensed in Florida, Jen. Can't imagine why there are no lawsuits in her county... Do they collect on behalf of any creditor in particular? -

Thanks for the info! I searched the county court records to see how frequently they file here and on whose behalf. NOTHING came up!?!?!?! Does Hanna file under their name or do they file some other way? -
My friend just called. She's very upset. Today she received a call from Hanna. They left no message, so she googled the number. Thus far, she's rec'd nothing in the mail. I've never tangled with them, but we are aware that they are one of the worst. I'm terrible with the search function so I thought I'd post to ask if someone could provide some info on how she should handle this, what to expect from these "lovely" people and if there are any special considerations when dealing with them. Any informative links would be greatly appreciated, too. TIA!

Thanks so much for the info! I told her to call her realtor and get a copy of the bank's acceptance letter so that she can see exactly what the terms are. I've been trying to get her to dump her current realtor for months, but she doesn't want to hurt her feelings....as I said, she's overwhelmed. I even called a friend a mine who owns one of the leading and most prestigious real eastate companies in the area for a referral to an agent well versed in short sales that also farms her area, but she didn't like his advice as to market conditions and went with someone who told her what she wanted to hear. You can lead a horse to water.....Well, thank you so much for your help. All we can do now is read the acceptance letter and take it from there. -
if someone sells a home in a short sale what happens to the mortage deficiency? Does the bank accept the purchase price as payment in full of the existing mortgage and everybody walks away OR would you still owe the bank the deficiency amount? Do they sell the remaining debt to a collection agency or do they just send a 1099C???? My good friend is selling her home in a short sale- due to close next week- and her realtor won't give her a straight answer!!! The poor thing has been hit REALLY hard by this economy through no fault of her own, her mother's alzheimers is getting worse, her daughter's husband died recently and a close girlfriend shot herself on Easter and languished in the hospital for a week before passing...She's just so overwhelmed and the last thing she needs is a realtor who yells at her for trying to determine what she will face, other than a hit to her credit report and score, after the short sale closes! Any info would be GREATLY appreciated!! TIA!

Thank you. Anything else I'm overlooking? BTW, the offer expires next Monday. Their letter was postmarked 4/16 and arrived on 4/19. The CA is another fun bunch out of Buffalo, Nat.ActionFinanc.Services.
