  1. Oh wow, I just followed the link to Oregon's website, I have no idea where to go to look for this. I will call the court in Lane County tomorrow and see if they can tell me how to file the answer... or if I need to due to the venue issue?
  2. The deadline for me to answer is Friday... I can overnight an answer to arrive on Thursday, do I need to send a copy to the law office as well? I am fully prepared to settle for the amount, it's for 1/3 of the amount, but I'm afraid that they will do a default judgement before we get the ball rolling on this as I wait for a letter...

Rec'd summons for Citi MC... however the summons was served to me at my residence where I've resided in Jackson County - and the summons states: "At all times meaterial hereto, Defendant was and is an individual residing in Lane County, Oregon." I have NEVER resided in Lane County. I called the law office today and they offered to settle with an amount that is totally feasable for me to do. I indicated that I didn't know how to file an answer when the summons showed incorrect information as I've never resided in Lane County. She put me on hold, and came back saying that they will have to file for a change of venue... My question is, do I still file an "answer" and do I include a motion to dismiss due to incorrect venue? They said they are filing for a change of venue and I will receive notice of this, along with a letter on how to proceed on the agreed settlement amount. My biggest fear is that this will take me past the 30 days to file an answer. If I need to answer, how do I do this when the circuit court where they filed is 6 hours away? At this point, I don't know how to proceed- I do NOT want a judgement to be entered because I failed to respond. Do I need to respond if I'm going to accept the settlement amount and pay in full? Please help.. I truly do not know what to do at this point.

  5. I think I posted this in the wrong forum initially - sorry for the duplicate. I have 3 accounts with Chase, that just switched from Wamu, had them for the past 10 years or so. I have a question, one of the accounts has been overdrawn for almost 60 days- received a call that if I didn't cover the balance by tomorrow the account would be closed. I just recently went back to work after losing my job- which is why this account has remained overdrawn- we are drowning right now. I have automatic deposit tomorrow of my fist paycheck but it will not cover the balance. If I make a deposit but it doesn't cover the balance will they still close it? I have tried calling today- but they are closed. Secondly, if the one closes due to charge-off- will Chase then go forward and close the other 2 accounts as well even if they are in good standing? I am going to call Chase first thing in the morning, I'm worried because when funds are deposited if they aren't cash- they hold the funds for batch processing, which clears overnight- so I'm worried my deposits tomorrow will not show as posted until after the 60 day mark. I'm freaking out right now.

  7. I read somewhere online, that they can disclose information about my debt to me only - as my spouses name isn't linked with the debt. I don't get it. http://www.cpflaw.com/stopcalls.html#spouse "Can a creditor call friends or family members to discuss my debt? No. It is illegal for creditors to call friends or family members of yours about your debt, unless you are under 18."
  8. I have a crediter for Double Day Bookclub, National Credit Recovery- who called when I was not home and spoke with someone else in my household regarding my status with them. I was under the impression that legally, they can discuss my debt with me only????
  9. Another question, this late payment is recent- do I need to wait a while before I send the goodwill letter? I just want to stay on top of this- but do they need to see a couple months of paid on time before they would even consider the goodwill letter?
  10. I did a search on "goodwill" letters and found this post your goodwill email letter working for paypal. I have a paypal card, through GEMoneyBank - and was 30 days late on a payment. I was late, I cannot contest it- but I figure I can sure explain the situation and hope they will remove it. The account is closed, and I'm still making payments on it - do I wait a couple months to show that I'm making payments accurately again? I've had the account for 3 years, and this is the first late payment I show on my credit report. Any advice you can provide would be greatly appreciated.
  11. THANK YOU. I'm trying to read through all of this, but man there is a lot of information and I don't know where to begin. Now I will search "goodwill" and see what I come up with. The Creditor has closed the account, I'm still making payments.
  12. Ok, I obviously have a lot of reading to do here. I have a quick question though- all of my credit card accounts on my report show paid as agreed, except one- I have one that shows 60 days late that was brought current. I have been reading that I need to dispute everything, however - this is legitimate, I was 60 days late- so is there any hope in having this removed so this doesn't look so bad?
  13. I have a question- we are thinking about doing a home equity loan to pay off all of our consumer debt. We owe 117K on the home, it is worth about 225K. Never been late on a payment, have a very low interest rate right now. Recently, we have racked up some credit card debt and want to get out from under it and all the high interest rates. My fico score is in the low 600's and my husbands is in the 670's - basically our cards are maxed and interest is killing us. Is there even a possability to get a home equity loan with our credit scores? Should we even try?

If you've had an NSF or Overdraft in your checking- that you covered by deposit when you realized the issue- and still hold the same account (I've had it for 10 years) do they report the nsf or overdraft if it hasn't resulted in you owing them money? I've just been reading all of this- I have an account with Wamu and have had it for the past 10 years, and I have had some nsf's over these years, but I always took care of them immediately. I guess I'm just wondering what results in a report to checksystems?
  15. what do you mean by "credit card enhanced" or Fico 2? Is there something else I should be looking at? I have pulled every credit report I can think of- and nothing is below a 698.
