I recieved a letter from a collection agency about a debt and sent in a certified letter asking for validation of the debt (I used one of the forms I saw on numerous forums and websites, asking for how they calculated what is owed, paperwork showing that I agreed to pay what they claim, verification or judgement, the original creditor, proof the SOL hadn't expired, proof that they are liscensed to collect in my state and their liscense numbers and Registered Agent).
All I recieved back from them was an envelope which was never sealed as it was wide open in my mail box along with a letter that they were enclosing documentation to substantiate the claim and what looks like a credit card statement from the creditcard company dated for September 2008. Now here's where my questions come in. In the section of the statement that has "Payment Summary" it has a part that is all wierd jumbles of letters (almost like someone just mashed their fingers against the keyboard or something to that affect). And the date on it is 09/2008, yet the card was charged off according to my credit report on July 2007.
This is the second collection agency who has held the account after the credit card issuer and I made the mistake of making 2 payments to the first company until I was unable to do anymore due to my husband's job loss (I know I screwed myself over with the SOL with that one). That was in March of 2008 but it was to a collection company, NOT the credit card company.
Ok, my question is, am I within my rights to send them another certified letter asking for better validation than what they sent? If I do so, should I mention that the envelope was open when I recieved it (you can tell it was never moistened to be sealed). And would the credit card company have a statement like that avaliable over a year after the account was charged off?
This company is one that I have read horror stories about on the internet. And I aslo made the mistake of giving the first agency access into my bank account for the payments. Should I be worried about that coming back to haunt me as well?
