I am so sorry for what is happening to you and family. In some states if a FC was started and than stopped because a repayment plan or mod was made the lender at any time when you are over 30 days late can FC. You should have gotten a notice( this can be just something in the mail) but since you did not you need to get the info from the court and contact the local Bar in your area for legal help. WV does have lawyers from legal aid , free and low cost to help. You will have to also contact your local reps (congress &ect). You may want to contact a local paper. With the new plan just passed you should get help. Do not walk for help run and do not stop until someone will hear your plea. Start phone calls, letters, emails and do not stop until you have someone standing behind you. Good Luck Keep us posted

Ok, that is what I meant by if you tax liability is X amount , you will get X amount as the credit, so if you increase you withholdings to get over your normal refund that will not change the tax liability amount . You will still only get back what your liability amount is. Sorry if I did not express this correctly..

Ok, I just had my CPA this weekend do my taxes, after reading this my head is spinning and I am not even getting the credit. Ok so the way it was explained to me is based upon your income (not your withholdings) your tax liability is always going to be X amount ( 0%, 5% tax bracket and ect). So if it gets passed as now written it is not a refundable credit which means if you tax liability is X because you make XXX amount your tax liability will always be X. If you withhold less to get a bigger pay checks you will owe XYZ to IRS as your liability never changed based on what you make not what you withhold. So from what I understood it went by what tax bracket you are in after deductions. I could be wrong about this but I think when it was explained to me it was done in laymen’s terms and I think I understood it.

And if this post is deemed inappropriately political, please by all means remove it. I am not able to buy a home at this time but I already wrote letters very similar to that. If this is going to have to be something my kids will pay for than it needs to benefit all not just the higher income bracket.

I understand this is a very emotional time and no one wants to loss there home but it happens. I have been in your shoes or should say similar. I am one of the ones that have lost there home and as sad as it is life does go one. I would tell you to write a hardship letter to WF and outline what you say your expenses are and how you can not afford the payment. I understand they turned you down but if you can not afford the payment I would put it in writing and send it CRRRM . Banks seem to be working more with people so you have a much better chance than someone a year or two ago. Other than the letter I really can only say that if you can not find work and are not able to pay your bills maybe BK would work for you, in a BK 13 depending on what the value of the home is some people are having second mortgages wiped out. I am no pro at BK but it is something you can look at if need be. As for your credit score it will rebound with late history or Bk. It will take work but it can be done. I hope others will chime in and maybe have better info for you. -

I see you like smoothies what I do for them at home is buy the extra large container of plain yogurt. I than buy fresh fruit if on sale and make them but I will use frozen fruit. 27 you’re still a baby in my book. LOL a few years younger and you could have been one of mine. Heck my husband is old enough right now to have a child your age. Oh boy my gray is showing better do something fast. We have always had one checking account and three savings accounts. One saving is just that savings and one is our emergency account, we use this if a car needs repair or something unexpected of any kind comes up. The final account is to save for any major items we want like taking a trip, new Tv or car. We have used savings accounts not checking because it is not as easy to get the funds out if we want to impulse buy (we have to transfer funds to checking and that is our cool off time to rethink our reason to buy) Hope this is of some help. -

I have 3 kids two are teenagers now. Since they act like they can not do with out soda or candy bars and other items I buy in bulk on sale. I use the bulk items to pack luck for kids or DH. DH likes the flavored water so I buy a bottle of the flavors he likes and just make it at home for him to take. I buy 12 pks of soda on sale and buy those 4 at a time. The savings to me is 1.25 a can. I than buy candy bars in the box, I think it is like 10 per box and than it saves me .50 a bar. I buy the snapple in the case also anything on sale that they will drink. For home use or when the kids can/ will take I use a water bottle and make peach Ice tea, green tea iced just about any flavor can be done from home and used in water bottles. The saving doing it all from home will shock you.For 5.00 you could make over a case of your own flavored ice tea. For lunch for DH I do hot open roast beef or turkey. It cost me maybe 6.00 for two lunches if no left over can be taken into work. For my kids I do soup that I heat up before they leave. I also pack oatmeal because they can get hot water. For times when they can not heat up meals I do turkey salad (with little or no mayo but add lots of veggies) over lettuce, egg salad and ect. I have also done fruit salads. What everyone seems to like is when I take left over masked potatoes (still cold) stuff them with ham, turkey or cheese pretty much what ever you like and can heat up or will eat cold, I than roll them into a log than bread them and bake. -
I would call the lender and ask for the mod. Explain your hardship and see what they can do for you. I don't know how they do the mods but I am sure they will tell you what is needed.

send a dispute the amount and the late or charge off is inaccurate. if they come back verified than you demand it be removed under BK law. Do this with CRA or if you just want it correted (which is more than likely this way) send a letter to OC saying this information is inaccurate amount, charge off or late, if they do not respond or they state it is you than demand it be removed (they may just correct). You can than use FCRA and BK laws to work for you. -

I am not a pro at this but from what I have read on CB and in news articles is if you do a BK 13 in some cases depending on the value of the home if the value is less than the 1st and 2nd collectively the 2nd can be wiped out. As I stated in the other post see if you can get a mod. If you are thinking of BK most lawyers will do a consult for free. Good Luck

Hi Dennis, Have you contacted your lender to see about getting a mod? That may lower your payment to a more affordable payment. You can also look into BK for the unsecured debt. Before anything look and see what rents are in your area. If they are the same as your payment or more see about getting a mod it may work out to be the same as rent, a bit more and sometimes cheaper depending on the area. Good Luck

Give your lender a call and explain about your income being less. The lender may give you a mod without being late on payments. Some lenders are doing mods without lates but you will have to call and make the request.
