Looking online it appears that the phone calls to myself and my family might not stop. Could someone lead me to the best letter type to send to them to make them stop? -

Thank you, everyone. I received a phone call today from the man who sent me the email. He wanted to make sure I received it and requested I reply to the email saying I had... Ok, sure thing, buddy. I'm not quoting, but he said something about me paying by Friday or they would need to take further action or something to that effect. I slept on it and read all of your comments and I'm not afraid anymore. I know I'm SOL and there is a wealth of knowledge here that will help me should I end up needing help. I wish I had the guts to actually do something about this, but if they stop here I'll be happy. I need to get back onto this site more often. I used to refresh constantly throughout the day years ago, but I've let it slip and now I'm sloppy with my knowledge. It's time to fix that. -

Thank you. Posting here has made me feel so much better (on numerous occassions). After reading his email, I'm right there with you. Can they call my family about this stuff still? Did they discuss the debt with your family? They didn't specifically mention a debt as far as I know. The "paper server" just told my mother that he was looking for me to serve papers in person. She asked him why he couldn't just mail them, and he said he couldn't talk about it, but it had to be done in person. The message he left on my in-laws machine said that there was a court action against me and they needed to get in touch with me. He left the phone number of the debt collectors on there. I listened to the message and it never mentioned a debt, just an action against me which is what concerned me into calling them. -

Ok, I got the email. It doesn't say anything about being sued. This is the full "Settlement Contract" he sent with the more personal bits omitted. OFFER OF SETTLEMENT This office is collecting an outstanding balance owed on the above referenced contract. Any information obtained will be used for that purpose. Our company is willing to settle any known or unknown obligations in this matter with respect to the above mentioned for the sum of $1,*** if paid in accordance with the terms which are stated below. Upon receipt of this settlement we shall consider the obligation as been paid and satisfied. Our company agrees to accept in full the sum of $6** if received in our office no later than March 3, 2015. Arrangements are as follows: Payment will be processed in the amount of $6** dated March 6, 2015. Upon receipt of certified funds, we will file a dismissal of the action. Our company will notify the credit bureaus to update the credit file to a PAID IN FULL. I thought it was weird, but I don't know if I can even handle it if one of those people showed up at my work. It makes me so nervous. I thought I was done with all this old debt stuff. I held my breath until I passed the SOL and then...this. -

Oh ok. Awesome. Thank you both. I think they did skip trace me since they had all of my relatives phone numbers. He asked my mother if I still lived at such and such address and she said she wasn't sure and that we didn't really talk. It was my correct address though, so it's a bit nerve wracking. I'll look and see if there's an online court search I can access. -
This afternoon, I received a call from my father in law. There was a message on his phone for me about a judgment or court action or something. It left a phone number and a file number to call. I told him it was probably spam and to just ignore it. Not two minutes later did my mother call me from work to let me know she just spoke to someone on the phone, the same someone as my father in law. He said that he needed to serve papers to me in person and wouldn't give her any more information. So this is where I get nervous because I've never been served papers for anything before. I called the number, which I know is normally a no no, but I wouldn't have been able to sleep tonight not knowing what it was. Turns out it was for a debt that I had years ago. I didn't say that I recognized it and asked him to please email me information he said was mailed 6 weeks ago (which it wasn't, at least not to my address). He said he was looking at the rest of my credit report and believed that I didn't receive the letter based on my credit. The debt was originally for just over $600 and I am being sued for almost $3k. He said that the person who had been hired to serve me had to get the papers to me by Friday because Friday would mark 6 years and the debt would be SOL. He said he would email me the info (still hasn't) and I said I would review it and see if I recognized it. He said that was being reported on Experian, but it's not. I double checked just now. I went into my filing cabinet and pulled out copies of my Experian report. There is an old account that matches the info he provided. However, the first time I was 30 days past due was Feb 2008 and the Date of Status (date it was charged off) and Last Reported date are July 2008. Over in the notes it says "This item was verified and updated on Mar 2009". I may have tried to have it removed via "not mine" at that time, but I'm not entirely sure of dates. I live in MA and the SOL is 6 years. I'm so nervous because there is supposedly a man coming to my house tomorrow to serve me. I'm contemplating trying to find a way to stay home from work for the rest of the week so I don't have to leave. I'm new to this situation. Could someone please give me advice on what I should do? I AM out of SOL right? I hope I'm not wrong about that. If I am, why does he think he has until Friday to serve me? Argh. It's so frustrating... Thank you in advance for all of your help.

So would it be in the SOL for you? No, unless there's a separate SOL for utility bills. I think credit card, written and verbal are all 6 years in MA. Haha, thanks. I kind of figured that I was wondering though if maybe it wasn't my account and they got screwed up somewhere. I never received a bill or anything so it caught me off guard. So, my thoughts on calling the electric company and not the CA are that I could find out if in fact it really is mine or not and if somehow it is ask them to recall it and hopefully go through them. I'm not sure.

Ok, so I got an alert from Credit Secure that there was a CA on my account. I haven't had a CA in prob 2 years so it's been awhile. I know the steps to a 1-2 and things like that but I would appreciate a little hand holding for a moment because it makes me nervous. I know the company this is for, it's an electricity company in a city I used to live in. I did at one time have an account with this company but I don't remember leaving any balance when I moved. I would have closed the account at the end of 12/07. Also, the address this is associated with on EX is not the address I would have had the account at nor is it a recent address. I did not receive anything from this CA or from the electric company. If they are using the old, old address that would make sense. But, since they have access to my credit report, it seems odd to me they wouldn't use the address I have lived at for the past 2 years. I was thinking I should call the electric company first but they're not open until Monday morning. What should I do first and in which order should I do the rest? I'm really angry about it so I don't think I'm thinking clearly. The CA also just appears to be a rinky dink little operation in small town, MA. This is not from a hard copy, this is from EX online. Status: Collection account. $211 past due as of Feb 2011. I got two of those today. I don't really see what the issue is and why we should scream violations. If you were curious over a year and a half ago why you hadn't heard from them then you could have called. I did. I also looked at the letters they linked to and I saw my denial reasons.

I am an AU on my husband's AMEX and have a BK7 from '07 on my report. I did not have an AMEX card included in the BK, or ever, so that may be the difference.
