  2. So the payment was due on 5/27/12, and I did not pay it, so 5/27/15?
  3. One of my accounts is about a month from being 3 year old, which is the statute of limitations in NC. I have hard copy's of of my credit reports sent to me, and it says the last activity on the account was 4/27/2012. Does that mean then if I were to get sued after 4/27/2015, I can use the fact the debt has passed the statute of limitations for my state in court? Thanks so much.
  4. Thank you. I figured in the late fees every month, but I did not consider the attorney fees. Do you know how long most people can get away with not paying? I was hoping 2 payments, 3 at the max.
  5. The 401k, my wife and I have do not allow a lone, but do allow hardship. In regards to BR, we talked to an attorney, and almost filed, but it would have been for 5 years, and really did not want to be dealing with that, with another child on the way. Can you explain what you mean about costing more going 3 months? Our payment is 1800, plus a 65 dollar late fee. Would it not be 5595 to catch up then? Am I missing something? Thanks so much everyone
  6. We moved into our home about 4 years ago. Wife was out of work for several months after we had a child, because of health problems. We lived on credit cards and used all are savings. Most of the cards closed and had to be settled. Long story short, we have struggled to pay the payment each month, but we have. Right now we are one month behind. We contacted the loss mitigation area of the bank, filled out the paper work and they came back to us with a repayment plan for the month we are behind. The problem is we cannot afford the monthly payment as it is, let alone extra, but they seem to think we can. We have cut all stuff out and just living with basic stuff, TV/Cable/Phone/Cell Phones. We also have another child on the way in a few months so it only going to get worse. If we were just given time to catch up everything we would be OK. I talked with my HR at work, and I could get a hardship amount out of my 401k, if the bank provides a pre/forclosure letter. Would that be something that allowed, or would bank tank my home away before I could get the money? I was thinking since we are already late for Nov, I would also go Dec, and Jan, and pay it all caught up in Feb. This makes me very uneasy, but I don't see we have any other option. Also what making things worse right now, is that 1000 a month of our income is going to an attorney. As this is for a judgement. That will be over with in Feb. I just don't know what to do, all around it not good. Thanks

  8. Thanks everyone for the advise. I was able to settle at 40%. I was happy with that and it one more off my plate. I am now down to 4 accounts left. Had a total of 30 when I started less than a year ago.
  9. I had a chase card that I have not paid in almost 2 years. I got a notice from chase saying they are no longer going to collect on the debt and they would write it off and won't be sold. I would receive a 1099 c shortly. This is great news to be honest, I have not had the funds to settle the 10k account yet, now it will just be written off. Yes I know I will get a 1099 c. I spoke with the firm that doing my taxes and since I was insolvent at the time, this should not impact my taxes. Yes I know I will maybe be blacklisted and it will be on my report for years, but at this point I don't care much about the number. I have a house, a car that a few years old and runs, and starting to have resv funds. I want to live credit card free for several years so I don't get myself into this mess every again. I have 4 accounts left to settle, I started out with 30. I will be so happy to get these last 4 done and start moving forward with my life. One year ago April I almost filed for BR, and I am really glad I did not. Just thought I would share.
  10. Thank you so much for the letter and all the information. That was a typo on my part. I moved to NC in 1997, and the account in question was opened in NC in 2008. The first default was 2012. The OC still owns the debt, and they have that law firm working for them. It for a GE Capital Walmart store card. The balace is not very high around 2500.
  11. Also to note, I have not received anything in the mail as of yesterday from these people, and they are not calling me. I am also not trying to hide from them. I want to deal with this debt, but at this time because of health problems, being out of work for a while we are trying to get back on our feet.
  12. Anyone have any dealings with Schreiber Law Firm? They have been calling my parents in another state, PA which where I have not lived for 17 yrs. I have received nothing from and nothing in the mail. I have tried calling them, but always goes to some voice mail system. I will keep calling just wondering if anyone has dealings with them. I am sure it one of the 6 accounts I have that need to still be settled. No idea which one. Still have another year before they are out of SOL. Thanks

  14. I have been working on accounts over the last year to resolve, I thought this one would be easy, even had an Amex account I had to deal with which was easy compared to this account. After talking to several people this past week I was given an address to send letter to offer settlement, which I have done. We will see. It odd though or maybe common, I don't know, my account already charged off, and has gone to 3 CA, and now it back at GE Capital. I am borrowing money from family to take care of this account, I just want to get it done with. 27 accounts I have settled so far, 5 left.
