  1. I have a similar situation from 2006 and am wondering if after the OC issues the 1099C, can they still attempt to collect on the debt? My thought is that they've been given the tax benefit and I've paid the penalty for the debt so the OC can't double dip. Is my thinking flawed? I am in Cali and the date of the last payment was in late Oct 2006. The acct was charged off in 2/2007 and the car repoed in 4/07. Date of sale was 6/07. The required notices were not sent. The SOL in my state is 4 years.

  4. (((((Lynn)))) I had some drama with my brother today and had to make the decision not to include him in my son's wedding. It breaks my heart, but it's a decision that was made after much heartbreak, history and deliberation. It's so easy to tell someone to not let it bother you, but it is your mother, so I do understand the hurt you must be feeling. I do know that I will be a happier person with the stress of my brother (specifically his wife ) and his drama out of my life. I adore my nephew and will miss him like the dickens , but there's nothing I can do about that at this point.

  6. I was an AU on a card that went bad. The card was closed and in collections. The account holder faxed a letter to the company requesting that I be removed as an AU, effective immediately. Within a week, he received a letter from the credit grantor that that I had been removed as an AU, per his request. The account dropped from my reports within a few weeks (2-3). And yes, my score did increase because it was a negative acct that didn't have much age associated with it. Good luck!

  9. DH and I were considering a new car purchase and had our credit pulled buy a new car dealer. Their credit score range is listed as 250-950. My TU was 672 and EX 628 (new mortgage wasn't appearing on TU yet). DH had 660 on TU and 641 on EX (mortgage not on his TU either). TU is now reporting mortgage on both reports. Why the difference in auto scoring models than "regular" FICO of a max of 850. What "tier" is this? On a new car, what APR would you expect? I thought buying a house would improve our rate when buying a new car. Should we wait for mortgage to age a bit to get a better APR on new vehicle purchase?
  10. I think I'm ready to opt in since my credit scores have increased. I do, however, still have some clean-up to do. Should I be wary of unintended consequences if I'm trying to repair and I do opt back in? If ok to opt in, how do I do it?

  15. Thanks for all the info CB'ers. I'm learning more than I've ever known about the auto buying experience. Centex--what are holdbacks? I USED to be one of those that would negotiate down from the MSRP and I would hear about others getting great deals and would wonder WTH? I am determined not that to be that kind of buyer this time, which is why I came to CB for guidance. For instance, we had another CB'er who recently bought a Camry, V6, same FICO, no money down, O APR, 60 months thru Toyota. All of our local dealers are offering (advertising) rebates OR 0 APR x 36 months.....I want it all but I'm not a strong negotiator.......
