Can anyone explain how a voluntary surrender to the note holder is reported to the CRAs? It's Ford Motor Credit if that matters.

I have taxes impounded on my mortgage which makes my monthly payment ~675 higher than my principal & interest payment. What is supposed to be reported to the CBs? P&I or P&I & impound? They are reporting the larger amount which makes my mortgage ratios huge and makes me look more in debt.

I have an esoteric question about mini Miranda. I am not late or in default with my mortgage, but their servicer (Caliber Home Loans) includes the mini Miranda, even where there is no debt, just to protect themselves. Is the a violation of some sort of FDCPA or the CA Rosenthal DCPA, for asserting the protection when it is moot due to no key element, the debt? Any comments welcome.

I have 2 situations: system worked flakey, as bad as other provider made payment on their promise to fix it, the didn't. so I disputed. now the only accept cash (sounds like an adverse action for seeking a protection) 2nd transaction Bought USB speaker over Internet it arrived DOA now they wont accept it back and it's >100 miles so credit card company say rules doesn't apply.

Has anyone come across how this dispute process deals with internet purchases. I was told that in CA, if the computer you're using is w/in100 miles of home, this clause is meet. I can not find any such state or fed regulation.

My uverse service have not worked since 2-13, and they have been waving the bill. In June they refused to do this (service still didn't work) and I paid by CC. A friend suggested since I was unsatisfied with the good or services, that I dispute the charge. I did and ATT didn't fight, they reversed the charge and just rolled it over to the next month and made me a CASH ONLY payment type. 1000's can pay by CC,other 1000's by e-check, but I have to pay cash. Sounds like an adverse action to me. Comments? -
I had a lien, which was "released in error" (the state addmitted they mad a mistake). The 2 other CRAs quickly picked up the updated public record. I have now disputed this w/ EQ about 5 time, and have even gone so far as sending the subject document number, and a copy of the lien release with my dispute. EQ said, tough we can't accept paper submittals, and our agent search the records and report the lien is still valid. Short of a lawsuit is there anything I can do? Is a complaint sent from the CFPB get me anywhere? It's been such a pain, I really would like the suit and collect damage. Any hints helpful

How can I find out if my debit can offers some extra protections directly from Visa/MC. When I asked my bank, the couldn't answer me. Thanks.

These reseller pull credit reports, "enhance" them, and then sell them to their customers. Do they take the role of solely a CRA or a business that accessed the file. I have a couple instances were mortgage companies pulled my credit thru these firms without my consent, and I'm wondering is they as well as the mortgage company are liable. Do CRAs have a duty to validate the permissible purpose for accessing a file? Thanks.

I wanted to share a success story on getting state tax liens removed. I am in CA, and was "late" filing a return due a to medical disability. I had no tax liability, but they filed liens (in some bogus amount). After filing the returns, they "released" the liens, which with other creditors expunges the record, but FTB is special and it stays for 7 or 10 yrs with a zero balance. It took dozens of letters, faxes, and phone calls to the FTB, their "advocate" (they're a joke), and my state senator. After 2.5 yrs I finally got the beasties removed. Now it's been six months and I am still trying to get the CRA to update.

I am looking for info on what rules if any govern dedt that is sold to a 3rd party rather than just collected by a third part. I have an account that was in dispute with a credit card company. The the debt was sold to Cash America/CACH/ Squared to Financial (S2). Here are the questions: If S2 never requested payment, and reported the account to CR. Can the account be reported as a "collection" on my CR. Is S2, the OC or is the card company the OC? Is S2 a CA? Does FDCPA/Rosenthal apply. Any web reference as a source of more info. p.s. A California specific question. I understand that all foreign entities that do business in Cali, must register with the Sec. State, and that failure to due so all the the Cali Sec. State to be used as the foreign entities' agent for service. Is they any other penalty that's imposed?

Does anyone know of lender actively offer Credit card hardship programs where the lower the rate or minimum payment for a period of time. I Google this and got vague and mostly old info. I would like to hear from anyone with current info. Specifically looking for: Chase Capital One Chase I am not looking for a "single payment" but it trashes your credit program. Thanks.

I recently apply for a new mortgage. It was intially denied due to some derog on my report. I sent them letters correcting the derogs. They still denied me the credit due to the drogs even after the were corrected . I have a small claim suit pending to get the drogs corrected, since the 3-bureaus refused to correct then when I disputed then Is there any state or fed law that prohibit the bank from using incorrect credit data in under writting the loan? Thanks

Thanks for the frankness. I guess I am in denial about a company doing a good job for a fair price. It seems there are still a ton of people that would like the "hand holding" -
