  1. Yes I beleive it is.
  2. I had an Amex chargeoff in the late 90's, the amount is small $260 but they have resurfaced. I received a letter from Redline Recovery dted 1/6/11 asking for payment. I pulled my Equifax report and this is how it is listed: Closed accounts American Express Current Status- Chargeoff Type of acct- Open High Credit $260 Date Opened 01/1990 Date Reported 12/2010 Date First Major Delinquency - 12/2010 Date of First Delinquency 11/2007 Balance $260 Amount Past Due $260 Date of Last Activiy- n/a Months Reviewed - 1 Activity Descrtiption- Closed Type of Loan- Credit Card Comments- Charged off account, account closed by credit grantor I knoe that I have not had an Amex for at least 10 years. How is this coming out of the blue now and I how do I deal with it? Redline is not reporting. It is reported the same way on my other reports.

  4. I Live in PA but according to everything I have read oon CB CapOne(in their cardholder) agreement stated that they will use VA laws, which is 3 years.
  5. My husband received a letter from Hayt Hayt & Landau LLC in the mail yesterday for a CapOne Credit card. According to the CRs the date of First Deliquency was 5/07 so it should be out of SOL, since Cap One uses VA sol, which is 3 years. The letter is dated 7/29/10. My question is, how to respond?
  6. Thanks for the help. I will send them the letter.
  7. On my husbands CR he has three charged off CapOne accounts. One is from March 2005, one from March 2007 and one from May 2007. They are reported as COs every month and the balance keeps climbing. He received settlement letters from the 2007 accounts last week in the mail, both settlements were for about 50% of the current balance. He(we) do not have the $$ to make the payments for settlements, nor do I think that paying htem will do any good for his CR...is that right? We are in PA, and the SOL is 3 years so the 2 from 2007 are reaching the end, which is why I am assuming they are trying to settle. My fear is is that CapOne will sue. How do I handle this? I am thinking the one from 2005 I am going to leave alone. ANy suggestions? Thanks!
  8. I tried to open an acount with a local CU and was turned down due to a Chexsystems report, so I order the report and this is what it says. Dear xxxx, Enclosed is the copy of the information currently in your consumer file at Chexsystems. This report is based ont eh identifiers you have provided to us. There is additional information on our files which is similar to yours, however since the identifiers you provided did not match those listed in our files we are unable to release that infomation to you. If you can provide us with the following identifiers, we would be happy to continue our search and release to you any additional matching information. - addresses for the past five years If you have any question, blah, blah, blah. The thing is I have lived at my address since 7/28/04. So this is the only address I have had for the past 5 years. What do I do now? and how?? Thanks!

  10. I googled the number, came up with this: Seven Flags Foods Nacodoches 866-645-8505 Texas
  11. I think I am misunderstanding by served do you mean by a Sheriff? I am trying to recollect if he ever was according to the court docs it wsa mid May of 2007. Can he be served by letter via US mail? This whole thing has my head spinning. I want to get it taken care of. UGH
  12. So how do I find out if they have a right to collect?
  13. Ok I found out more information-I looked on the County website and here is what it said: Case Details Case Number: 2007-**** Commencement Date: 5/14/2007 9:58:24 AM Case Type: Complaint Civil Action PFA Number: Caption Plaintiff: CAPITAL ONE BK Caption Defendant: ********* Judgement Indicator: Yes Lis Pendens Indicator: No Status: 4 Judge: MOORE Parcel Number: Remarks: Sealed: No And then it goes on with the Docket info.
  14. so how do I proceed?
  15. How do I find out what state the judgement is in? or is it a county thing? He was never served. This is the first thing he has received from them. If I need to be be extremely carfeul, how do I proceed? It sounds in the letter like they will accept payment arrangements? Should I send a letter to tat effect?
