  1. OK thanks. I might just try the "return to sender" approach on the mail and see what happens.
  2. You can have a trial to dispute it, but I don't think you will win if you have already paid some of the ticket. Normally, in order to pay you have to enter in a no contest or guilty plea. Do you have warrants? Tickets turn into warrants where I live. They don't turn into warrants in my state. No warrants. I am not going to have a trial to dispute it since the only benefit would be that they stop sending me notices. The city can't do anything other than send me letters. So, your car was stolen, parked at a meter, and when you found it, there were no tickets on it and the thief was already in jail for something else? As cruel as it may sound, your "family member" broke the law. You should ALWAYS file a police report just to CYA if nothing else. Did this "family member" know about the parking tickets? I suspect there is a lot more to this story. They drove the car to court and I guess they were hoping to get bail but the judge made them go to jail for several days. I don't see why the story matters though. I was just trying to see if there were any laws like the FDCPA that require them to either stop communication or sue.
  3. Well the city thinks I owe them. I never received the original tickets so I do not know if they're valid. Someone else basically stole the car and parked it illegally. It took us a while to find the car, which was parked at a meter. We didn't file a police report since a family member took the car and they were already in jail. I assume it's too late to dispute the validity of the tickets so I am trying to focus on finding a way to get them to stop sending the mail. Sounds like there's no way to do it?
  4. I receive parking violations from Complus Data that processes the paperwork for a city. The citations are from 2006 so it is past the statute of limitations, which means they cannot sue over it. As far as I know, they can still send me letters. I sent a letter to Complus Data telling them not to send me letters. They are still sending the letters. As far as I know, they do not have to follow the FDCPA. I emailed the City Attorney and he ignored me. Is there any way to get them to stop sending me letters? I paid the original fines I just didn't pay the 200% late fees that they charged since I never received the original tickets. They're still harassing me nine years later.
  5. Cite the text of the law that says it's illegal. You can't. It's not illegal, it's against card company policy. HUGE difference. Actually, valid contracts are enforceable by law. That's basic contract law. So if they violate their contract, that is in fact illegal. Perhaps what you are thinking is that it's not a criminal offense. They cannot be arrested for violating the contract, but they can be taken to court to settle their dispute. In their contract, the companies state the consequence of violating their contract, usually involving fines. That is why merchants are fined when they violate their contract. http://library.findlaw.com/1999/Jan/1/241463.html
  6. It's up to the merchant whether or not they collect signatures. I emailed American Express about it and here is how they responded. Dear [ewic12]: Thank your for your e-mail. We appreciate and value your Cardmembership since 2005. I truly regret the delay in responding to your e-mail in a timely manner due to the unusually high volume of e-mails to American Express. Please know that merchants who accept American Express Cards have their own policies for taking signatures on the receipts. It is totally on them for this policy. It seems that the merchant you are referring to have a policy of taking signatures over all receipts, while there are merchants who take it only for higher amounts only. It is totally on the discretion of the merchant to frame their policies in this issue. American Express has no say over this with the merchant. Normally, a merchant does this to avoid any difficulty just in case he has to provide the Signed Support Itemization if a Cardmember disputes a charge. It becomes easier for the merchant to deal in those scenarios to prove their point. Please be assured that you are a Valued Cardmember and we are sensitive to your concerns. Additionally, we assure you of our best attention at all times and excellent services. We are committed to provide you with excellent services in future as well. I hope that I have provided you with sufficient information to resolve your inquiry to your satisfaction. It was my pleasure to assist you and if there is any other way we may be of assistance, please feel free to contact us. Sincerely, /A.[last name] Email Servicing Team American Express Interactive Services

  8. This is why you should get an American Express card. Their dispute process is painless. You can do it all online and I have never been required to provide any documentation or anything. I did do a dispute with Chase once and it was a mess. I've pretty much stopped using that card as a result. I only use it now if I somehow end up going somewhere that doesn't take American Express.
