So my concern was just that if I don't pay them monthly, they will sue. If they sue, they will likely get a judgement to freeze my account since I'm not paying. but if I pay to avoid them suing me and getting a judgement, I run the risk of this being reported once paid in full. So it seems that I have to keep making monthly payments to avoid being sued even though it might appear on my credit even after it's being paid in full.

if the CA does not own then debt, I would not pay the CA. the CA owns it according to the OC then why would the DDS office accept payment? I really don't know what to say to that except that is what they advised me. All I know is that if I don't pay them monthly, they will sue. If they sue, they will likely get a judgement to freeze my account since I'm not paying. If I pay to avoid them suing me and getting a judgement, I run the risk of this being reported once paid in full. nobody can just file a judgment. a judgment is obtained through a lawsuit. to initiate a lawsuit, the plaintiff must file a complaint and also serve process on the defendant so the defendant knows he/she is being sued. eventually, the judge will enter a judgment. check out the medical/hipaa forum on here. i don't understand the "helpless" portion of your post. what is the SOL for this debt? have you ask the DDS office to recall it? hi, it definitely did not reach the SOL. The debt was from work done this year. The DDS wouldn't recall it although she said i can make payments directly to her.

hi hegemony, I'm paying them monthly with Postal money orders. They haven't sued me yet. My concern was that I'm going to keep paying them monthly with no guarantee that it will not be reported. THey don't want to write a letter stating that they will not report to the credit bureaus if I pay in full which is what I need. Without this letter I am making monthly payments and will pay in full taking the chance that they will report me anyway. I didn't want to continue monthly payments without this letter since no one wants a paid negative mark on their report. But if I don't pay them monthly, they will sue. No, I have not been sued. What I did leave out pertaining to my bank account being frozen last time was that it was an IRS matter. I'll clarify that I'm not so concerned with garnishment but I am concerned with my bank account being frozen, very much so. If I'm understanding your post correctly, you're stating that my bank account will NOT be frozen without my prior knowledge because when and if they sue me I will be notified? And if they file a judgement on me I will be notified? Is that right? And yes, my concern was keeping this off my credit after the balance is paid in full. Without that letter they can easily write, stating no reporting will be done if paid in full, which they will not do, than I can pay the $800 in full with monthly payments and they can still report it and I can't do a thing about it, I am helpless and have to continue to pay monthly unless I want to be sued.

hi, the state is New York (City) and it's a dental collection agency that works closely with the dental office. This collection agency refuses to send me a letter indicating they will not report to the credit bureaus if payments are current and balance due and I'm still paying them monthly with receipts and return receipt requested via Postal money order (no personal checks). I don't want to stop paying them their monthly $50 to give them a reason to get a judgement/summons/bank freeze (just b/c they don't want to write that letter) but if I keep paying until the balance is full, without their letter stating they wont report to the bureaus I'm just risking my report. thanks for any advice you can give.

Is it possible to avoid a bank freeze? Collection agencies file judgements without summons I imagine since years ago I woke up to a bank freeze and was never served. I just really need to avoid a bank freeze for so many reasons and if being called to court is after a bank freeze I don't know if I just shouldn't be a wuss and cooperate since I thought I could go to court to avoid a freezing of my accounts. Thanks for your reply so them actually obtaining a judgement to deplete or freeze my bank is POSSIBLE and my not knowing when they would do that and waking up one day with my account frozen is possible? If I don't sign their document saying the terms can change in 6 months at their discretion than they likely will NOT accept my payments and get their judgement. Is their anything I can do to avoid this? -

In a nutshell, I made my first payment to the OC who works closely with the collection agency. In my letter along with my 1st payment I asked if she can send me a letter indicating no reporting will be done with the 3 credit bureaus as long as my payments are current and balance paid in full. The OC called me and said she would have to discuss it with their collection agency. They work closely together. In a few days I received a letter from the collection agency (after I spoke to the collection agency over the phone and told him I would be paying the OC directly, he said that was fine as long as she was ok with it ) stating I needed to put $100 down and make subsequent payments to their offices instead. In other words, I ask for a letter stating not to report to the bureaus and they change their agreement. The last sentence of the letter states "Your failure to send back the signed agreement will lead us to believe that you have no intention of keeping the above payment arrangement" There is a place for me to sign and even a section for me to put my ss#, how convenient. I will send them a letter back indicating that based on my verbal agreement (I kknow it should be in writing) I will continue to send payments to the OC as confirmed by him as well (over the phone). I have a feeling he'll tell me not to make payments (gut feeling) unless I sign whatever he sends me, he's strongarming me now and I know the OC will just tell me to deal with him. Obviously, I can not afford to have my bank account frozen which I know can be done (I've had this happen) without you having prior knowledge. How can I work this out with him if he wont send me a letter stating he'll not report it? I can't afford not to send payments b/c they will go after my bank account. Thanks
