A poster over in a law community is stating that it is illegal for a creditor to sell your debt to a collection agency. This is false correct? If so can someone please give me some info that states its legal for this to happen? Thanks in advance.

Back story. I have an 03 Sable that died while in reverse. Took it to our usual mechanic and he said the computer was dead. Got us a new one but couldnt find one with a key already coded to it so he called around and found the lowest price for having the current key coded to the new computer. Just spoke to him and he said the dealership he took it to is saying the key is bad and I need a whole new key. My question is, how is this possible if the key would turn off the theft light like it normally did. When inserting the key it wouldnt flash rapidly or anything just stay on and go out after all the other dash lights turned off. Does that sound like a bad key? So now they want $130 for the key and $65 to code it.

Ive had Magicjack since last September. I completely got rid of my POTS two months later. I love it. Of course its not without some flaws but nothing major. I have Verizon DSL with it. You need to have some sort of high speed internet to use it. Ive heard that satellite doesnt work with it though.

we did ask them about this and they claim they have no where we can drop it off at.

This would be the likley solution BUT consult an attorney before doing so, abandonment is the first thing to come to mind. As one poster said, if you do bring it back to the dealership and get something signed by them you can and will probably lose any rights you may or might have. They could care less wether you still pay for the tags and the insurance while it sits there but the first time you take the thing to the store you might walk out and find it gone. Again, I would consult an attorney before doing anything. well its not being driven anymore so i wont have to worry about it being taken and getting stranded somewhere. we do have a second car that we are still using. basically what weve decided to do is surrender the tags and park it on his dads property and let them know where it will be. at this point im just hanging on by my fingernails to keep everything else afloat until things get back to normal around here.

not a dumb question. its an 06 elantra and we still owe over $10k on it and have been paying on it for 2 years already. weve basically already paid for the car but all its gone towards is interest. weve tried selling it but nothing. refinancing it has been a no go.

would i be able to just take the car back to the dealership it was bought at and have them pick it up from there?

yes marv, thank you. well theyll get about $5k to $6k for the car at auction so its not like they wont be getting anything. it would make more sense to me to get the car asap so they get money from it instead of it sitting there and they are getting nothing. i dont plan on having it parked illegally at all its just frustrating. this is the last thing i want to do but its either screw up the credit now and work on fixing it again or just completely drown and be completely screwed.

yeah i know these are just as bad as a company initiated repo but we have no choice. my question is this... does anyone have any idea why it would possibly take a company 2.5 months to repo a car? i just got off the phone with nuvell to find out if they had a date yet as to when theyd be picking up the car so we can take the tags off of it. we live in a condo so the association wont allow us to leave the car parked without tags. the man on the phone said it will take about 2.5 months before someone will be out to get the car. i mean doesnt that sort of defeat the purpose? they are going to end up repoing it anyway at that point since we can no longer afford the payments, period. its so frustrating! we finally started getting back on our feet with bills being caught up and then hubby loses his job!

Try your local credit union. Thats usually the best place to start if he can meet the requirements for one.

oh ok well them there is income. as long as she can provide proof of income she should be ok. i was approved for nfcu but i had my own income as well as hubbies so i cant really say for sure.

umm probably not since they do ask for employment verification. secondly, why would you want credit if you have no way of paying the bill?
