I have searched this forum and can not find how to become a member of the NFCU. I do not have family in the military but understand that there are other ways to join. Could someone please tell me how I need to join.

How long do I have before they repo my cars? I have a Chrysler and a Honda. I quit paying last month.

Does it still help to build credit if you put someone one on your CC as an autorized user. I know at one time it did help..but not sure about now! My daughter needs to build her credit.

I am getting ready to file BK chapter 7..How will this affect my loan?

It is a direct loan..... Do I need to consolidate it? Will that help me with payments? I think I have 2 Loans with Direct Loan in the amount of 20,000 and 11,000 . Payments are 375.00

Yes it is in deferment now...it is a direct loan.

I have a Parent Plus loan that is coming due that I can not afford. I don't think that they will work with you based on income I am getting ready to file chapter 7 and know that they will not discharge the loan. Are there programs. out there to help with these payments? Shoul I get this worked out before filing? I have heard that once you file they will not help at all.

I just received a civil summons today on a equity line of 47,000. First of all, It went to the WRONG address( my parents which I have not lived there in 25 years). I am very upset that this happened... My question is there any thing I can do since the address is not correct? I thnk they did this on purpose to harass me. My loan papers that are attached to the summons has the correct address on it! I know that I have 30 days to respond, what happens if I don't! I don't think that they would forclose because I am current on my First Mortgage and it is underwater by about $4,000. Do they just issue a Judgement against the First? I tried to go to this credit union and ask for a modification and they said that they do not do those on equity lines and could not help me. Any suggestions?

forclosure on a second mortgage

Would a sale fetch more than is owed on the first mortgage.? If the holder of the second mortgage tries to foreclose, they would have to pay off the first mortgage completely before they get a nickel. I had the same thing happen to me. Seriously under water on the mortgage. BOA threatened to foreclose on the second. I knew there wasn't enough equity to cover the first mortgage, so I ignored them. They never followed through. The tax value that was just updated and reappraised was 298,000, I owe 306,000 on the first! What do they go by as far as how they appraise? Do you think the tax value is about right or is it always low? -
I have a second Mortgage with State Employees Credit Union In N.C. I am in a trial period with Wells Fargo on the first. I owe approx 308,000 on the 1st and the second 47,000. I am waiting for the modification to be complete before I file BK. The tax value is 298,000. State employees credit is saying that they will forclose, our atty told us not to worry that they will not take a loss. I keep getting letters and today someone drove by and took pics of our home. Do they go by your tax value? Are they serious? I know that I can file bk and stop it if they do, but I want my modification to go through. I have heard that if you file BK you will not get the modification. I do not want to lose my home. We tried to get them to modify the 2nd but they would not. Any one had this happen? Do you really think that they would forclose over 47,000? I will make my last trial payment in nov and then the bank said that i should get the modification in 30 days. ( modification with freddie mac) I am getting worried now I am 6 months behind on the 2nd. Are they just trying to scare me?

I have a second equity line of approx 45,000 that I have not paid in 3 months. I tried talking to SECU to see if I could get a modification and they said that they did not do those! I am about to file bk in the next month or so, just waiting to get the money. Anyways, I received a visit from SECU today at my home, I did not answer the door and they left their business card. I find this a little weird for them to come to your home. Anyone had this before? I live in NC and My home is approx $100,000 under water. But I do want to keep my home!

We got our notice of forclosure and I have a few questions. Does the sherriff have to serve? We got ours be mail! (not certified) Can I call the Attorney that is handling my case and ask for a extension? (daughter in college living there) I would like to delay at least 30-60 more days. How long after sale to evict? This is with BOA

Yes, if somehow your daughter had recently signed a 1 yr lease with Mom, she would be able to occupy the premises until the end of the lease, rent paying of course. Absent a written lease or expired lease and month to month tenant, the LL is required to provide the tenant no less than 90 days notice to vacate. Housing Authority in the City of LA During the term of the lease, the tenant has a right to remain in the unit and cannot be evicted, except for actions that constitute good cause. - If the lease ends in less than 90 days, the new owner may not evict the tenant without giving the tenant at a minimum 90 days notice. - At the end of the term of the lease, the new owner may terminate the tenancy if the new owner provides a 90-day notice. I don't guess that this will help me. She does not pay rent... only utilities. Please talk to an attorney if contemplating the above. I do not recommend it. The lawyer will likely have a discussion with you about arms length transactions and fraud. Protecting Tenants at Foreclosure Act....... Requirements Under the Act •The new owner must be the “immediate successor in interest,” such as a person or the bank that foreclosed on the property. •The tenancy or lease must be bona fide. The tenant cannot be the mortgagor or a member of the mortgagor’s family. The tenancy or lease must be the result of an arms–length transaction, and the tenancy or lease must require the payment of fair market rent or rent that is subsidized through federal, state or local subsidies.
