  2. I was hoping someone could tell me why you send Why Chat's repo letter to the dealership where you purchased the car along with the OC and CA. I'm sure there is a reason, but I can't seem to figure it out nor can I find the answer. Thanks a lot!!!!
  3. I'M SO EXCITED!!!!!! I have only had 2 collections previously removed from report when I started out this clean up process and those were from the blanket dispute I did. It's not a big account, but I sent NCS a DV letter for an "alleged" account with BMG and I just received their letter stating that after their investigation they are remitting my file back to OC, ceasing all collection activity and will request deletion from my report. A small victory, but a victory none the less!!!!!
  4. Well that moron did it!! He really sent my account to an agency! I received a letter in the mail today from Nationwide Credit stating that my past due debt with BOA has been placed with them for collection. I find it very interesting that they did not send this to their legal department. Could that be a sign that they know they screwed up?!?! I will add these guys to the Whychat letter and also DV them.
  5. So I called almost every law firm in my area and of course no one really deals with this type of law. I finally made my way to one particular attorney who does deal with these cases and his advice to me was: 1. There is nothing that can really be done about the abusive behavior of Shawn 2. BOA will probably eventually try to litigate and it would cost more in the long run to prove the commercially reasonable issue than the settlement offer amount. 3. I should really consider filing CH. 7 BK What on earth is going on????? Is this just small town law or is my situation worse than I thought?!?!?
  6. Thanks cfj!!!! I agree! I did place a couple of calls today and I'm hoping to be in contact with an attorney by the end of the week. I was thinking of calling his office and asking for the information on the "agency" he banished my account to!!! Oh and yes I saved his lovely message. It's even more unbelievable that he would leave that kind of crap on my voicemail!

  8. UNBELIEVABLE!!!!!!!!!!!!!!!!!!!!! As stated before in earlier post I have received a settlement offer and all the information I can from BOA and they are basically just waiting to see if I am going to pay it. The member of management that I spoke with once again confirmed that Shawn the CSR that was so abusive was not to call me and that she would be handling things as she is his supervisor. The due date for the first payment of their settlement is 11/25/09. Yesterday I missed a call from them while at work on my cell and I listened to the message left and guess who it was... Mr. Jerk himself Shawn!! After all this time he has gone without calling here he is again. So I called back but asked for his supervisor Wendy who has taken over my account. Well she just so happens to be on vacation this week. So I spoke with another CSR and stated that Shawn was not to be calling me and he said yes he sees that on the account, but maybe he was just calling since Wendy was on vacation. Today I woke up to a missed call and message from Shawn again stating that I have not made an attempt to pay on the offer they extended me and since I called and complained about calls being made to me he is sending my account to an "agency" today! Is that not harassment!!!! I can not believe the nerve of this guy!!!!!! Can he send it to an "agency" without waiting for the due date on the settlement to elapse without payment?
  9. Just curious if anyone knows why we send the letter from Why Chat's page to the seller of the vehicle? I will definitely send it because that is what he says to do, I am just not understanding why I need to send it to them? Thanks a lot!!!!!!!
  10. Thanks Why Chat!!!!!!! I have a suspicion that since they received that first notice back as undeliverable they didn't even try to send the others to me. They of course claim they did, but I did not received those either. It makes since to me that a pink slip could easily get lost in the delivery process and I would have no knowledge that I needed to go pick up a letter, but that doesn't explain why I didn't get the others they sent that were not certified. I would bet money they didn't even bother sending them!!!! Ok so I am going to get the letter out to them ASAP!

I received a call from the local post office this morning and they stated that their records show that a notice (sorry we missed you slip) was left on April 14th at the correct address and that they returned the letter on April 24th. Now 2 problems I have with this 1. I had 2 roommates at the time, both long time friends of 10 years, so had something come for me in the mail they would have left it for me. The mail always ran around time for me to go to work or shortly after I left so my roommates always checked the mail. The strange thing is that crazily the highlight of one of the roommates day was when the mail came. For some strange reason she had this thing about checking the mail so if anyone had come to the door and asked for a signature on something she would have jumped on that then been on her cell texting me to let me know some mysterious letter was delivered. 2. The lady that called from the post office said that normally certified letters are kept for 15 days before they are ever returned and for some reason this one was returned after only 10 days. She said that she has no idea why this letter was returned too soon. So not really what I was hoping to hear and now I have no idea if this changes things for my situation. I mean it definitely doesn't change anything with the commercially reasonable sale issue, but wondering if it could make things harder with the not receiving any notices?

  13. Thanks a lot cfj! I am still wondering if anyone can help me understand the questions I have about the Carfax report I listed in post #36 of this thread. I am not sure if it is relevant to this situation, but it never hurts to at least understand what I am reading! LOL Thanks everyone!!!!!
  14. Thank you Why Chat for coming along and giving the expert advice!!!!!!!!! I have opted out and done what I can as far as getting addresses removed. I contacted my local post office and asked if they can do a full trace on the certified mail receipt number and I was told that they can not print it off and give it to me but that they will try to see if they can find out if there was an attempt at delivery and if so to where and when. I had to give him my phone number and he will call me tomorrow and let me know what he has found out. This will be the 3rd person I have dealt with that is going to "try" to find the information. Unfortunately I am dealing with a very small town post office and I am starting to think that they are using pre-historic equipment! Just as you suggested Why Chat I have been keeping a transcript of every phone call. Honestly I did not have that intention at first, but when I received that second phone call that turned into the CSR being abusive I went back made transcripts of the first call and have done that with every call so far. I am actually keeping the notes I make on my notepad during the call and also keeping a record on my computer. Hopefully I will get the information I need from the post office tomorrow!
  15. Thanks for the information gerray! I guess that answers my question about whether or not it will stand up in court that I did not receive any notices. Its as if that makes no difference as long as a company can prove they attempted to mail the letters! Anyone have anything on the Carfax report questions?? A big THANK YOU to everyone who has helped so far!!!!!!!!!!
