"you all" really wasn't mean for "all of you". yikes! are the bars open yet? no offense meant or taken LOL plus you didn't really put it Texas style.. ya'll I was born in texas and then spent 12 years of my life at fort hood, tx... ya I know... so it was still a shock for me to find that law... never in a LONG time had I known it to be there.. If I was you, I would DV them just like I would anyone else.. if they get froggy make sure you prepare for every possible outcome.. I will DV them, via CMRRR letter. Would it look better down the road if I now contacted the apartment and try to work something out, you know, just in case this goes to court? I can say, well, I tried to contact them, Your Honor, to work something out, and here is the certified letter/email/recorded phone call????

  4. NOOOOOW, you all get it! Hell if Texas does become its own country, I may ......will ....just move. No telling what kind of rule/laws Governor "Hair" come up with.......... so I guess since they can come in and take your stuff, I guess it's perfectly okay for them to just send something to the CA and say you owe X amount of dollars without OC trying to work contact you and work something out first FIRST?!
  5. But it is in the lease that they can, in bold italic letters, and I have sinced moved....the TVs together were worth about $150. Now their CA sent me a letter the other day saying I owe them $1855......tha apartments NEVER contace me first, said it wasnt "their policy to do that". ASSTARDS!!!!!!!!! now what???????
  6. UPDATE: I know I shouldn't have called them, but called the apartments that had the CA send me the letter, and I said I wanted to speak to the manager. Manager was not in. (ha...never is.) so chick asked what this was about and I told her "collection agency letter.' She asked if I was a former tenant, I said, yes. She asked if I broke a lease, I said uh-huh. And asked her why they never contacted me. She said "it is not our policy to contact someone when they break the lease or move out without giving a 30-day notice". I said fine and hung up. I suppose I will still DV with CA?
  7. That's just it. I always get the personal insurance when I use my debit card. I am trying to avoid paying insurance. It is 25.99 a day....the daily rental for the car is only $21.99 per day. If I used the credit card and an accident occurs, VISA shoudl pay......right? Maybe I'm confused.
  8. I occasionally rent cars with Avis and with a debit card, they have recently went up on the "hold" amount to $400. YIKES. Plus, I don't have a personal auto and always take out their insurance. YIKES AGAIN. I have a BOA checking and savings account and was told I can open a business accct (I have an EIN from IRS) with $50, ( I can always add to the account when getting ready to rent a car); and with their VISA business card, the auto rental insurance included with the Visa card is one of their perks. Do rental car companies still consider this a "DEBIT" card?? Or I can TRY to go for the BOA secured card. Which is better for my situation when trying to rent with auto rental companies without using my debit card????
  9. I was personally never locked out, but my neighbor came home from work and was locked out. Guess what? Her and I removed a window pane, unlocked the window and she got in! They have locked out some many people in that apartment, it's a crying shame.
  10. It is used by the Texas Apartment Association, which most apartments use in Texas. Stupid, dumb, ignorant rule. They can't take pictures, clothes and work-related items (tools, computers, etc.) One landlord back in December even came into a lady's house and took the Christmas gifts she was given! It made the news here and the TV showed her kids and everything. People were absolutely outraged. I mean, this landlord, CLEANED her out. One lawyer said she could file theft charges!
  11. Seems that computers should be OFF LIMITS anyhow just due to the fact they could contain PERSONAL INFO... I can't begin to explain how pissed I was when my son called me and told me the computer and 2TVs were gone and the office had left a "list" of items they took. Thank goodness I was all the way downtown and had 40 minutes to cool off. I went in with a cool head the told her the computer needed to be returned NOW. AND since this was an aALL BILLS PAID property, they thought they had disconnected the lights from the apartment, but they only cut off half the lights. I forgot to mention that in my orginal post.
  12. In Texas they can for non-payment of rent...........nothing else. Not even then unless it is written in the lease. It is in the lease, which is why I may rent from a private owner from now on. They usually won't do this.

  14. I signed a renewal lease back on October 31 for six months @ 825 per month. When the rent was not paid on the 14th of November, they entered my apartment when nobody was there and took 2 TVs and a computer for non-payment of rent. The computer I got back the same day though. I raised hell, and under Texas law if you use something for work-related purposes, they CAN'T take it from the apartment. On the 24th of Noveber rent still was not paid and I finally decided that I needed to move, as the area was crime-ridden anyway, plus I couldn't come up with two month's rent. Went 4 miles away and told the apartment manager that I didn't pay for November and didn't give a 30-day notice. She approved me because she said I was upfront and honest with her. Paid deposit and a $299 move-in fee. Been paying rent ever since December here. Today (5 month's later) I get a letter (current address) from their CA (Collectron of Atlanta, Inc. in Stone Mountain Georgia) saying I owe $1855.50 and the standard 30 days to inquire......yada, yada, yada. Never once received a letter from apartment Yeah, I know......shouldn't have signed, but didn't think I had an option when I signed. My question: Respond to CA's letter saying I don't owe this (do I really) or do I contact the apartment office and work out a deal, (like paying for November and if they will get the CA off my flowers?) ......please don't be rough on me......it was a rough time.
