Please help before I make a mistake in filing chapter 11

I have not been getting emails letting me know that there were posts here, sorry. If you want to contact me with anything, here is my email address. StraighterSwing@aol.com Here's an update. I have emailed and called the attorney's. I have sent all of the information they requested via fax and confirmed with them that they received it. Since then, I have not heard back from any of them. I have left multiple messages and sent many emails asking for a status report with no success. From their "silence," I'm assuming that there is nothing they can do to help me in my quest for relief from this horrible experience. I have been getting the *nasty* letters in the mail from the collection agency for Huntington with threats of wage garnishment among other things. Unfortunately, it looks like I will be pursuing the bankruptcy option after all. I'd just like to thank everyone for their support, guidance, and advice. I hope that others will read this post and think twice before co-signing for someone (even family). I have adopted a new philosophy when dealing with these issues and I hope that others read this and pass it on: "If you cannot trust the person with your ATM card and pin, then don't trust them when your financial future is involved." Liz Pulliam Weston from MSN Money has posted my experience on their website as well as 4 other debt stories from hell. To see it go here: http://moneycentral.msn.com/content/Saving...debt/P68952.asp Again thanks to everyone. -

 Here you are trying to help me and I'm not responding. I have not heard back from the first lawyer I sent my paperwork to. I have also to send the letter to their lawyer, repo-company, and dealership if I remember correctly. I'm planning on doing that this weekend. -

Sorry people... I haven't gotten any emails letting me know that there were new posts. With the counseling started this week, I've been kind of strapped as to my non-work time on my pc. -

Co-signers have rights in these cases. I thought they were just passive bystanders who get screwed in cases like this. If you have any info, I'd appreciate it. I'll start looking. -

No offense taken. Things can get pretty aggravating when dealing with issues like this. It was repo'd this year. If it makes a difference, it was considered a 'voluntary repossession' I still did not get any information before the sale of the vehicle. The lawyers I contacted and sent my information to have not responded with any good news. Although, they have not responded with any news so that can be a good thing too.. Thanks for the concern and support. -

Here's what I found out up 'till this point. The LEASE was through Huntington N.B. Thanks to the court system for providing the lease agreement. There is still a pending suit against Huntington but the statute runs out 2 years from sale. This one was bought in Jan of 01. Even still, the lawyer asked me to send him the paperwork and he'd go over it to see if there was anything he could still do. I forgot it was a lease until I got the lease agreement out. There still may be hope yet but it does not look good. My wife has gotten an evening and weekend job but that will pretty much pay for her car's payment and its' insurance. *Sirrowan* I did legwork when this first started...I didn't know to investigate the repo-law. I looked into the rights of a co-signer because I was not contacted to make payments. I was just sued later on for the balance of the LEASE. Thanks for the links, I'll check them out... ******** -

I'd love to pay them back the money incrementally. But they want $200/month for 8 years. I'm sorry, I don't have an extra $200/month. I barely have enough to make it now. After all of our bills are paid, I have under $10.00 in my savings and checking account. We use our credit card (1 credit card) for gas and groceries and pay that when it comes in instead of worrying about my wife running out of gas with my daughter in the dead of winter because she didn't make it to the bank. I could get a second job and pay them $100/month but they don't want anything lower than $200. Talk about SOL. If I told them that I was filing bankruptcy would they take the $100/month or still go for the $200? -

[quote name="CramItCCCAs How can you afford the counseling? If it HMO or insurance that is paying for 6-8 visits your better off reading a good book. Those 6-8 visits are a waiste of time. No such thing as good short term therepy IMO. the best thing you can do for your psyche is to have it out with your sister in law and the both of you work out a way for her to either pay for the balance or work toward paying it. She can't file BK on you' date=' if that's what she thinks she's doing then you need to sue her.[/quote] My company has a plan called C.O.N.C.E.R.N. I'm not sure what the acronym is but they help employees who are having problems ouside of home. Shoot, if I had to pay for it, I wouldn't be going. -

I'm happy to see that people are viewing this (218 at last count). I hope this helps many other people too. BTW-I start counseling Monday for this crap. My wife asked me to go so I'm humoring her. Nothing like seeing a shrink to add insult to injury. Who knows, maybe it will help... -

Note to CramItCCCAs: I know I should but right now she is also our babysitter. I would love to sue her. But not only would we lose her as a babysitter (and around here, daycare is 50+/day), but my wife would lose the only family member she has in the area. My wife visits her and her kids and they play together. It would probably hurt us more if I did that than it would help me sleep. I'd lose more because I'd have to get a night/weekend job and a paper route in the morning before my 8-5 job to pay for the daycare. I agree but unfortunately, she has us by the throats. She never threatens us to stop babysitting though. -

It was a Jeep Cherokee. Great Info! What's my next plan of attack? Should I contact the collection agency, GMAC, my lawyer? Thank you so much. You might have saved me tons of sleepless nights. -

Yes I am shouting. In my cubicle, I'm shouting thank you to my computer screen. Talk about desperate.
