I had the same thing happen with Bellsouth and NCO. BS is bad about that. They apparantly left my phone connected even after I had left the state and had requested it be disconnected. NCO showed up on my report late last year. I wrote a VERY STRONGLY worded letter to NCO and they folded. I think you should ask NCO for validation. If they can't provide it, I would think they would go away based on my experience with them and BS. BW

They reported me as 60 days late several years ago while I was in forbearance as well. Unfortunately, I do not have any records of the forbearance period-but have never been late on a student loan and I know that during that period of time I was definitely in forbearance. I have disputed this over and over but they never delete this. Hopefully you will have better luck since you have written proof. BW

I just wonder if your lawyer is my lawyer. I'm in the same boat right now. Waited almost two months after initial meeting to have complaint filed. Complaint filed with inaccurate details this week before I could okay it. Now waiting to have amended and served. I figure it will take some time to get through the process so I try not to think about it too much. BW

So I know quite a few of you have gone through the same stuff with this company. I have been trying to get validation from them since November. The classic A$$t story. All the usual stuff...statements on their letterheads, letters back telling them that is not validation, reporting anyway. Increasing the balance each month, reporting factoring company, open, 120 days late, all of their usual goodies. A gazillion violations. So I stopped sending them letters two months ago at the advice of my attorney who was very excited about my case, offered to take it on contingency (I didn't ask) and would "handle it from here." So they have still been updating without validating (and yes I did everything within the 30 day period). Well my attorney STILL hasn't filed anything...he keeps promising it "this week" or "next week". The new problem comes in when a couple of days ago they put on my EQ that they cannot locate me. Then all of the sudden today, my hard inquiry which they refused to remove disappeared as well. I have numerous CMRRs that prove they know exactly where I am. I also have tons of credit reports that show the hard inquiry. My line of thought is that they are trying to say they cannot find me so they can pull the service by publication stunt and get a default judgement. (WAY out of SOL and I have 100% proof I don't owe and never did owe a dime). If the inquiry is on there it shows that they DO know where I am since I have not moved in years. Any thoughts on what they are up to or what I can expect next? Thanks!!!

They will not go away. They do everything they can to poison your report. TONS of violations. Document every single thing. And like the PP said, do not call them. CMRRR for everything. Keep very thorough records....they rack up violations fast. BW

Yes, they absolutely ARE a CA and they do not validate and they do not go away. They violate over and over and do not care. They WILL report even if you request validation within 30 days and they cannot provide it. They will poison your report by reaging, listing as a factoring company account, 120 days late, etc. They will increase your balance every month and report it as a CO every month. They will try to threaten you into making a payment to reset the SOL then turn around and sue you. They will lie to you about not suing you and get a default judgment. And send EVERYTHING CMRRR....your lawyer (which you will more than likely eventually get if you want to get rid of them) will thank you one day!

No...asset won't fail to respond. They'll just respond with a bogus account statement on their letterhead and when you tell them that they failed to validate they will tell you they have reviewed the account and marked it as disputed with the CRAs. They just don't CARE about the rules! This is their game. They will report it as incorrectly as possible to try to make your scores fall as far as possible. How else does your score fall 50 points for a 6 year old bogus account. Smush is right...collect violations then go after THEM! BW

Given it's age it shouldn't go on your report...but it's likely they will reage. They'll probably report it as a factoring account turned over to collections just a month or two ago, speaking from experience. Mine isn't as old as yours but it IS out of SOL too. They think they are above the law. Just document EVERYTHING. BW

Okay...this is just a shot in the dark...since I used to do corporate taxation... It is possible (don't know how likely, haven't researched this or thought it through) that they are booking these things as revenue at full "value" when they buy them--with some impairment booked also--so it is in their revenue numbers already. Then when they "write them off"...they are taking the difference out of revenue. I think if they are booking them at full value when they know these things are JUNK...it might be an SEC/investor issue. Not sure that investors realize how junky the junk is that they are buying. Kind of like the creative accounting at Enron and others... Just trying to think of possibilities... BW -

I am... ...although I'm "retired". I'm not sure if they are filling them out and sending them because they are writing it off...or if this is just another method to screw everybody. And I don't profess to know squat about the accounting practices of those clowns. I'm just thinking that there is definitely potential for them to have some fraud going on. They can mess with the FTC but they darn sure shouldn't mess with the IRS! ;-) BW -

Not sure if this is directed to someone else....but I never said I wanted someone to take it without a retainer. I WOULD, however, like to get to an opinion of what I have as well as a feel for the person on the other side of the desk before I start slapping down cash. I think that professionals are worth every single penny when they know their stuff. But I don't want someone to run up 50k in attorney's fees if I'm not getting anything. So if someone will take it on contingency...all the better. And if I need to pay a retainer to get them started I'll be happy to. I called someone in another city listed on that website...just a shot in the dark. They were listed as having "advanced knowledge" and guess what? They are moving to my city in a month. I am supposed to call back and four and she was going to have a list of things the attorney wants me to send over. BW -

Go to http://pacer.psc.uscourts.gov/ and on the left you will see a register link. You will need a credit or debit card, as the service charges a nominal fee (.08 per page, but you will know ahead of time how many pages are for a document you plan to pull). You will log in, and then select the civil link (this is for civil cases). Then you will see a place where you can type in party name. Type in, for example, Asset Acceptance, and then click search. A list of cases will show up. keep in mind that many of these scum agencies go by many, many names, so you may have to perform multiple searches to find what you are looking for. Feel free to message me if you have any questions I can answer. each search costs $.08....just an FYI. I think that's why I haven't done any searches yet. I was confused about how they charge. I need to just bite the bullet and rack up some fees! -

You could try a search on Pacer...using Asset Acceptance as one of the party names. The filings contain names, addresses, and phone numbers for the attorneys representing the consumer. Benefit of this approach is that you know they have experience, plus the attorney will probably jump at the opportunity to sue the same scum multiple times. Economy of scale, and all... Also, everyone who sues should look up their targets on Pacer to see what is out there. Helps to see how others are approaching the suits. It IS the lovely folks at AA, I just signed up for Pacer this weekend...I haven't given it a whirl yet. Guess it's a good time to take a stab at it. My state is FL. -

Yes...the one on that list is charging $200/hour for the consultation.
