  1. I'm looking for advise from those of you that have had luck back dating an AMEX Account. I established an account in 1990. I closed it in 2001. I'm trying to backdate my current AMEX account to this original member date. On my first attempt, the rep said they couldn't find my account. I have my credit report showing the account and the account number. On my second call, the rep said she would submit the request with the account number I had, ssn, and dob to be researched. However she said if there was a gap of more than 60 days I was out of luck. This is proving to be more difficult than I thought. Anyone else have the same experience? Thanks.
  2. I finally received some information from the OC. It appears that the bill may be from the last month of service when I owned the place. The OC said they would pull the bill back from collection if I would pay the amount plus the 25% fee they paid to the collection agency when placed. The money is not that big a deal, I just want the thing of by credit report. If we do it this way, can the CA still report it? Thanks,

  4. Evertything that I can find for Oregon shows a 6 years statue of limiations. I saw a couple posts in my searching referencing a 2 year statue of limitations for cell phone providers and utilities, but couldn't find where this came from. Regarding the 30 day issue. I contacted them after finding it on my credit report after subscribing to CTT. I looks like it was reported in 7/2007. I have certainly had my credit pulled since then, including buying a house, but I'm guessing since it is only reported with TU, it just never came up. Won't they just claim that the 30 period expired in 8/07? I also see now that after my initial letter, they hard pulled my TU credit, but didn't update the debt as disputed. But, I guess if they contend it is outside the 30 day period they are okay on that? Thanks,
  5. So I spoke with the OC today. They were actually pretty helpful. They show the account was sent to collection, but beyond that they have no other records of the account do to how old it was. They couldn't tell me the dates of service or any information I need to determine whether this is actually mine or not. They are going to do some further checking for me. They have not spoken with the CA since this was turned over to collection in 2006, and didn't know anything about a lawsuit.
  6. I used this line in the PFD - "This letter is an offer to amicably settle the above account. It is not to be construed as an acknowledgment of my liability for this debt in any form. " I have not tried to contact the OC, it sounds like that is the next best step. Their letter specifically states, "The Unit Manger who handles your account has asked me to approve a lawsuit against you because you have not yet paid the account. The suit has been approved and it is currenly scheduled ot be filed on or about the date stated above." If I find out the OC did not authorize the suit, is this statement a violation? Thanks,
  7. I have the newbie section on Valdidation and knew that a DV request may result in a lawsuit before I did it. But now that it's a happened I can't find the next step. Here is my situation. On 10/11 I noticed a collection on TU for a Utility account from 5/06. The listed date of service is 5 months after I sold the residence, and don't believe an amount was due when the property was sold. I didn't want to deal with it so I sent a PFD. After a couple days I received a letter from the CA dening the PFD, and stating they would send under seperate cover an itemized statement from thier client. Two weeks later (10/22) I had not received anything, so I sent a DV letter. On 10/31 I receiveded a notice stating that a lawsuit has been approved and scheduled to be filed on 11/09 if I didn't pay. Is the next step to send another DV and dispute with TU. If they can prove the money is due, why not just send it to me rather than file suit? Won't they have to provide the same information in court? Should I premptively hire a lawyer? It will probably cost me 3 times what I owe, but now I just want to win and would like the best chances of keeping it off my CR. Thanks,
  8. Just worked for me..
  9. I had a phone message when I got home tonight from a lady talking way too fast asking me to call her back "reference" a number she left. I did some checking and found that the call came from a CA, Caine and Weiner. I checked CCT and found no collections on my reports and don't have any idea what she is calling about. No accounts hanging out there, etc. Do I send a DV letter now to their address and the "reference" number, assuming it is a collection? Call her back and find out first? OR? Thanks,
  10. Long story short, I called BofA to get a new cards sent out as the mag strip on mine was not working. When I did I got sent to the credit review dept. The CSR was actually very polite. Paying minimum payments for a year and then a large payoff is what prompted the review. I explained the financial difficulties which prompted the minimum payments and turnaround which allowed me to pay-off my card. She was very nice and stated everything was good. Since everything was going so well I asked her if she could help me out with 1 60 day late that occurred at the beginning of this mess. She again was polite, and stated she would if she could and I probably deserved that, but it would be illegal for them to report inaccurate information. I didn't really know how to respond, but "Oh, Thanks anyways." So what is the response? I found a telephone number for BofA Executive Customer service, but would rather write a letter. Is there and mail address? Thanks.
  11. I sent a PFD letter for an old utility bill: Other Topic It resulted in not only a "No," but a hard pull with TU as well. Can they do that? Why would they do that? Thanks,

  13. I finally found this in reference to cell phone bills and "wire communications:" US Code Title 47 But still have found nothing special about other utilities such as electric bills. Any other thoughts? I just want to verify what Lynn37 in suggesting. Thanks.
  14. Is there a special SOL for utilities. I've searched quite a bit and what I can find for Oregon, is 6 years across the board. http://www.acollectionagency.com/statuteof...ions/oregon.php Thanks!
