  2. I keep getting differant answers and was wondering if anyone knows for a fact the answer. I was told that a original creditor is bound by the same rules as a debt collector and has to stop calling if you send a cease and desist letter to them. I as told this is true since I am in Florida. Is this true? I also have them the original creditiors calling me at work 5-6 times a day and I ws told by my boss if the calls do not stop I will be fired. I have asked then to stop and they said since they are not a debt collector they have the right to call my work and will continue to do so.

  4. No rush on me, but the finance guy said that I was approved through Capital one and only approved on 1 car a 2006 Maxima for $12,900. He said if I didn't get that one this weekend he had another buyer coming to buy it and I would be out of luck. quote It will cost you dearly if you don't wait till you have discharge papers in hand. Marv do you mean cost me dearly with the courts or with the interest rate? I can't get the guy to tell me what the rate is all I know is the car is $12,900 plus tax tag tile and a extended 3/36000 warranty payments 369 60 months.
  5. I have a chapter 7 bankruptcy that is supposed to be discharged 5/15/12. I am looking to get a car afterwards. I talked to one dealer who said anyone fresh out of a BK would need a minimum of $3,000 down for a used car. went to another dealer and he talked me into doing a credit application ect. He came back and said he had me approved with $500 down and he can do something called a spot delivey to where I take the car now and it will be final once I show the discharge paper work. Does this sound right? I don't know which dealer to believe.
  6. Correct took money out of my mom and dads account that only has their social security checks deposited into. Here's another link about this right of offset. Is the Credit union saying that the checking account you all share went negative and so they pulled money out of your mom's account to cover the deficit?
  7. My mom is on mine and my wifes bank account from many years for a just in casr thing. She has never used my account. We had a car repo'd and was negative in overdraft $237 and behind on a cc. My moms name has nothing to do with either. Well my mom and dad have a bank account same bank. I am not on it. Today my mom went to teh bank to withdraw money. Her and my dads ss checks are deposited there. They told her she could not get the money that they transferred her money to pay off my negative balance and the credit card. IS this legal? It is a credit union if that matters.

  9. Got a call from a attorneys office called Wagner and Hunt today at work. THey are calling for a debt owed to Dell computers. I bought it im either 2004 or 2005. THey wanted my bank account number to take out payments I can't afford. I said no. They said if I don't agree to it they will file a lawsuit. Amount owed with fees they said is $2,000. SInce our income is considered below poverty level can they still garnesh my wages? Also I asked them not to call me at work anymore and they said the can call me anywhere they want since they are attorneys is this true?
  10. Better off just sending them a regular C&D letter then I am guessing. If they sue guess I will have to deal with it then. Not much they could get my bills every month are more than our income. Trying to work it out with the original creditor but they refuse to talk. THey keep referring me to the CA.
  11. I found this letter on the boards here. Is this true that you can just tell a CA that you no longer want their services?   13. THey aren't offering me anything,just to buy the home for payoff and rent it back to me with the understanding I need to be able to qualify to buy it back with in 2 years. I have called the mortgage company and they either want a huge amount by Ma 8th or add $300 more a month to my payment. Neaither one I can do.
  14. HOw do they go about taking your equity? What should I be looking for?
  15. Due to being behind on my mortgage and unable to get refianced, I am being threatened with foreclosure. I found a company that has a investor that will by the property, pay off the mortgage and rent it back to me cheaper then I am paying now. He said I will actually be on the paper as owner as well and will have to buy the property back in 2 years. ANyone have any experiance with this? Is this a legit way to keep my home?
