  1. I have done some research but I think this is ridiculous and just a post to vent. My step-daughter recently received a summons for a lawsuit over a credit card account that dates back to 2002. We hired an attorney to fight the lawsuit. A couple days ago we got a settlement offer from Midland for another credit card account opened in 2001. We went online and found that she now has another account reporting from a another CA. Here are the kickers!! In 2001, she was 12!! Our attorney is already taking care of the lawsuit. For starters all accounts were opened when she was between the ages of 12 and 14, so the accounts should never have been allowed to open. Her name is mispelled on all accounts, but the SSN is correct. All of them are past the SOL However Pinnacle is reporting the date the account was opened as Jan 2007 Midland is reporting their account as opened APR 2007 These two accounts are not part of the lawsuit. Am I correct in pursuing to educate these people that the accounts they are trying to collect on were opened fraudulently. That they are beyond the SOL and that they have improperly reported the dates the accoutns were opened? NM2

  3. My last 2 are 54, I paid for my filing fees and had DD. I thought I would get my rebate the same. I filed in Feb. I get the error message. I was hoping to get DD by now so I could pay off Home Depot and get some stuff for the house. 12 months/no payments But I guess I am complaining for nuthing, after all I could not be getting any rebate. So will sit and wait, any one else on this boat? NM2
  4. The O/C had Charged off the account in 2004, the balance being reported on the CRs is 9K, but the interest and late fees bring the total to 12K. It is on my reports, but the O/C is applying all my payments to the principal, so there is a $200 drop in the balance every month. My scores are: 656 TU 646 EQ 648 EX with the C/O reporting. I would probably be absorbing the payment into my debt to income ratio Yes, my DTI is 30% without the housing expenses, but I will be able to reduce that shortly. I would end up with a DTI of about 40% if we include the housing expenses. I will be paying off a few small accounts and will free up more monies for the DTI. NM2
  5. I have a 3 year old charge off, the balance is 12K. I had been making payments to a collection agency, but then negotiated with the original creditor to take back the account. The O/C says that they will send a letter/fax to the mortgage lender showing my payment history. The O/C says that as long as I am able to make my payments to them, they will not interfere with my attempting to get a mortgage. Should I try for a mortgage? I would really like to move out of my townhouse, the neighborhood is starting to go downhill. I don't have 8K to settle, and only 3K to put on a home. I have a good income with about a 30% DTI. I can afford up to 1K for a mortgage payment, the homes I am looking at are priced about 125K. My monthly income $4200 gross My scores are 640 to 656. TIA NM2

  7. I applied for the iTunes Visa, I got the "futher review" message almost 2 weeks ago. I check my app status and still says under further review. Somebody else was on here saying that they applied, but I haven't seen any threads about who's been approved or not. I did a search and can't find who it was. Any input would be appreciated NM2
  8. Go for Blue, I got it with scores in the 640's, I have a few paid C/O's, no open collections, minimal inquiries, less than 10 on each report at that time. I got a 2K CL, I am sao glad I got it, that is my card of choice, you'll love it!!! NM2

You can use a pre-paid card, no reason to buy the 89.95 product unless you want to, AND FOR GOD'S SAKE DON'T PULL YOUR #'S EVERYDAY!!!!! if you can afford that, then you don't need to care what your scores are. If your want to check your progress, buy your scores now and then again at 6 months. twice a year is ok, and unless your about to do a major purchase (home or car) you can go check. Just a guideline. NM2 PS. Use True Credit for your *b* purposes.
  10. I don't know the California laws, I hear that they do protect the consumer a better than other states. You will have to do your research. Start a paper trail, make sure everything you send is CMRR. Oh and one other thing, STAY OFF THE PHONE !!! I cannot stress that enough. It is for your own protection. Do a search for any and everything involving your situation. Read the psychdoc transcripts again. Keep me posted on how thing are going. NM2
  11. I had a CA do that, except that with me it was two pulls within 30 days. I wrote them a letter and stated: Dear CA, I noticed that you have pulled my credit reports twice within 30 days. I understand that you may have the permissable purpose to pull my credit reports, but only if the debt is valid and you have provided proper validation of alleged account. Also, since you pulled my credit reports twice within 30 days, I am interpreting this as a coercion attempt. Since inquiries do affect my scores, you are blatantly attempting to harass me and put me through despair which I do not want. This letter is serve notice that I will not put up with coercion in any form. I am sending copies of this letter to the BBB, the FTC, and my *fill in your state's* Attorney General. Any further activities which may be peceived as harassment will be fowarded to appropiate agencies. You may have already violated the FDCPA and/or more of my civil rights. If you cannot provide proper validation, then remove the inquiries from my credit reports and/or delete the account. You have 10 days to comply with this request or I will consider this to fall under the "Doctrine of Estoppel". That is as close to what I wrote to a pesky CA who tried that tactic with me. You can edit it in any way you may need. When you mention harassment and civil rights in the same letter they tend to run away. Don't get too technical as to what may be deemed harassment, it keeps them off balance and gives you leverage. Be prepared though, some may not fold quickly, this letter will get rid of them as long as they have doubts as to what they are doing. Good luck. NM2
  12. A friend of mine on here, had FP and Orchard, closed FP a couple of months ago. It didn't have any impact on his score, he still has Orchard, but plans to close it. He got in with a couple of the prime cards, and as he put it "...the scores can go up or down, it doesn't matter". He doesn't plan on making any major puchases in the next few months so eventually his scores will climb up. I feel the same way, except that I am not in the prime arena yet, so I have to stick it out with Orchard until I can get my baddies to go away. NM2
  13. Teni, Sweetie, if you had a bad check floating out there, you'd know it!!! They'd know it!!! You wouldn't go to jail, even if you had a bad check, you might have to make a court appearance and explain it, pay it, and then go home. When you write bad checks for thousands and skip town, thats another thing. I think that the real issue is the fact that you have quit paying attention to what it was you were originally doing. Let the bank find out if you had a bad check, their archives will show some kind of annotation in regards to it. Go after the CA thats wrecking your or DH's reports!!! NM2

  15. I was just "sharing" when I posted the topic. Got the idea from the "Hard Rock" post and just did a search for Kiss Credit card. Already searched for the AC/DC Card... there isn't one. Thats because Angus won't stand still long enough for the pic!!!! Now there's a much better band from that era NM2
