  1. Whew! just got the email and ran right over to find out what the heck is going on. My first thought was to start downloading all my favorite posts! Did a few, then found this thread. I hope you find the dang egit that thinks today is April 1st it's not funny!
  2. All the info you need is probably in Pychdoc's siminar's. You can find all 8 of the siminars here. If you haven't read them yet, take time to read thru all 8 of them, most of us consider them the equivalent of finding gold in this here site! They include excellent advice and many great links to specific information such as sample letters, the 1-2 punch, and much more.
  3. This law makes me think she MUST be served before any further action. It provides an alternative in case the summons gets lost.
  4. I was not aware I had access to my reports either until the day I found creditboards.com. It was a real eye opener to read the posts and learn that I have the right to remove the errors on my reports. I've had a bit of success, but still have a long ways to go. Posts like this encourages me to keep working until the job is completed. Thanks for sharing.

  6. edited to add: She does not have internet and can't come to the site to read and learn for herself. She is totally depending on my advice to get her thru this. I want to help her clear this up, but even thou I've been here reading and learning for a year or more, I'm not sure I'm savvy enough to see it through with her. I'd feel really bad if I gave her advise and it hurt more than helped her so I decided to stop by here and run it by some of you before going any further than I already have.. So far I've told her that IF they call, hang up, don't say a word to them on the phone. Next I told her to go to the court house and check the computer for any legal actions with her name involved. (Our local court house provides this service to the public.) I also told her to come by the house and we'll print out her free yearly CRA's so we can try to track down where this originated. I also told her not to worry, we don't have debtors prison in our country so nobody is going to come drag her off to jail. (yes, she was this upset when her friend called and told her her name was in the newspaper that MCM had filed a lawsuit against her) Now I have a few questions... 1. Can they actually take this before a judge without her being served? I mean... is it possible that they published a notice in the newspaper, or sent a letter to an old address and she didn't receive it? I've seen cases in the past where legal papers were tacked to a persons front door and the process server signed a statement claiming the person had been served. Maybe service was tacked to some old addy she lived at years ago? They obviously know she lives in the area because they filed in the local court. 2. Would it do any good to DV them after they have filed or would this be a waste of time? 3. What about estoppel? Would that halt any litigation until they contact her and at least tell her who they are and why they filed suit against her? 4. The only debt she can remember defaulting on was a cc that is SOL. We think it may be this or possibly the debt belongs to someone with the same name. 5. Is there a way to halt the suit? I thought they had to provide the court with prove of service before a case could go on the docket. Any suggestions? She's a great daughter in law, I don't want to cause any family rifts by steering her wrong on this. And at the same time I don't want to set by and see her get railroaded by a CA. Any suggestions or advice would be appreciated.

  8. I have 2 - 30 day lates, one from 2004 and one in 2005. Would it do any good for me to send a goodwill letter? Has it been to long since the lates were made? Has anyone had any luck with them removing old lates with a goodwill letter? It really hurts that this 16 year old TL is now reporting as a derog because of 2 lates in 16 years. On the plus side I got a stupid derog removed. It is a current bank account that is in good standing. I still use the account, but somehow it got a derog TL as a chargeoff of $80.00. I had to fight them for several months, but it's finally straightened out. I also have more good news (I hope!). Remember the $2.00 collection my bank had reported? They said they would remove it. It didn't get removed, it morphed into a chargeoff! I called my bank and they agreed with me that it should never have been put on my report and they are removing the TL completely. They said they would remove it last time, soooo I hope it totally disappears this time. The woman I spoke with at the bank was very friendly and said she was removing it as soon as we got off the phone and for me to check my report in 2 or 3 days to be sure it's not showing up. She gave me her name and ext. and told me to call her personally if it does not vanish from my report. That sounds promising so I have high hopes that another neg will vanish soon.
  9. The addresses came back, one of them came back as my current address. I sent a copy of my drivers license proving my address. They still insist that I live in another state. And, they claim that my single family home is a manufacturing company! So much for getting things straightened out... 1 of the bad CL's is back on my report. I know they couldn't verify it. The account was opened in a state where I've never lived, at an address where I've never lived. I've personally talked to the company and they told me they have no account in my name, but the TL is back on my report. Time to do a bit of research and hit them with something that will get it off and keep it off.
  10. I don't hold it against you for having a job and earning a living. (Heck, I'd go to work for them if the pay was good enough!) I like everyone. I spent an hour swapping jokes with the cop who stopped me for speeding last week. What the heck, he's just doing his job, the best he can, and dodging the bullets. Somewhere during our hour long BS session, I advised him to find himself a safer job... (BTW, he still gave me the ticket. But I made a friend!) I can't help wondering why you posted that info here and announced that you work for FICO. Who will benefit from the announcement? How can it help you, us, or them? These are questions I'm asking myself and I haven't found answers to them, yet. Can you do me a favor? Tell your boss to adjust my score to reflect my REAL payment history, instead of the fairy tales that are on my CR's. While your talking to the guys in the penthouse, ask them if they really believe that companies that can't get a simple address correct (even with a copy of my DL) can honestly be trusted to keep millions of numbers correct.
  11. Are any of them out of SOL? If yes, send a full C&D. I would send limited C&D's to any that are not SOL.
  12. Been there, done that, that's why I'm here now. Remove him as AU. Now I'm paying for it with my credit scores. When I get my credit repaired, there is no way hubby will be AU again.
  13. It's not on EX. EQ shows it as an open account owned by an attorney in MA. (It was an old insurance policy that was canceled in 2002.) I'm fairly sure that SOL was last month. (based on date it was placed with CA)
  14. THANK YOU for posting this. I have a super old SOL account that has been making the rounds to one CA after another. Now I know how to kill it off forever.
  15. I toss all my paperwork in a zip lock bag (the new XL size!) then go out to dinner with a friend. I forget about it for a week and then I can pick up with a fresh attitude and get moving again.
