burying it would be an idea however we're in the interior part of AK so about 2-3ft down or so you run into permafrost so thats the end of that idea. I am thinking that I may just "bite the bullet" and sell the darn thing for parts on CL if I do end up getting sued at least I can say and have the letter to prove that the last payment made was in april 2008 and that since they didn't come get it and it was obvivous that they knew where it was because they sent us a letter saying we defaulted and they were coming to get it,that they really had to intrest in the auto and that we held it for that long to give them the opp. to come get it but when they didn't we assumed they abandoned it and we sold it for junk -

I do agree that I don't really want to rock the boat so to speak. We owed about $8,000 on it when we stopped paying for it we had only made 6 or 7 payments. The car was never registered in AK it tore up shortly after arriving here and before we had everything switched over. So it is still sitting there with SC tags on it. The car needs both a new transmission and engine. The engine that was in it was from a different pick up truck and the tranny from something else they didn't line up properly where the tranny goes into the engine thus causing the flux plate to keep breaking and putting the torque converter into a bind but it also wobbled where it went into the engine and caused that area to become enlarged which will be very expensive to fix. I know its not worth their money to come get it heck it isn't even worth having a tow truck pick it up and auction it I'm sure. I spoke to the DMV here and they said basically I'm stuck with it unless they will release the title and they don't have to. I can't get a salvage title because I was registered owner but it doesn't mean someone else like a friend can't. It doesn't mean that once they find out someone wants it that they won't spend the money to get it hauled away for storage at a junkyard and then neglect to pay for storage so the junkyard would sale it. Thus keeping us from getting any benefit from an alleged sale. They would then turn around and sue for the balance however we have a strong foot that they had no interest in the auto because we defaulted in April 2008 and they did nothing until 2010. They did say that the tow place would go after us if we pushed it out onto a public road because we were owners. -

That is what I was thinking as well. I know when the tax people come around they are going to bust me for it not being current with tags so I really want the thing gone. I really don't have a clue what is the best way to handle this and I am also wondering since there has been no payments in such a long time and they flat out side they don't want it back and aren't coming to get it can they put it on our credit and is there like a limit to time for them to do it. I mean they can't list it as a repo because we still have it,can they? -

No we paid no payments on it since May 2008 and we dropped the insurance then as well. It is not on any of our reports I checked all 3 a few weeks back. -

Lemon law only covers new autos in SC from what I can tell. I thought about the charity thing but the only 2 here we have one will only take it with title and the other only takes it if it is less than $1000 to repair. We're in a small town in Alaska so not a lot of options like some places. Someone asked us about buying it for parts so I thought about that but I don't want to get into trouble but I don't want thing here forever either. I spoke to an atty once kind of by luck and the person said mail them and tell them that your gonna sale it or make them an offer if they will send the title but I don't want to really put any more money into this junk pile,kwm. -
Here is a little background. I bought a used auto 2.5years ago from a small car dealership lot kinda a buy here pay here place. The car was repaired 2 times under warranty and we repaired it out of pocket 4 times all within the first 6 months of owning it. It was purchased in 1 state but we moved to a different one 4 months after we got it. It finally messed up again and we were done pouring money into it so we called them and told them extactly that. The guy laughed and said it was out of warranty so they weren't going to fix it. So we told them to come get it. That was in May 2008 the car is still sitting in our yard broken down. They won't come get it they say it isn't worth it. They had some lame collection place contact us over a year ago but when we threatened them with legal action because the place represented themselves as private invest. with the Atlanta police dept that was the last we heard. The car is an eye sore and we want it gone but we don't know what we can do. We thought about writing them a letter saying they had to pick it up or we were going to charge them. We tried calling and finding out about having it towed away but they won't because it was registered to us. Can anyone help guide us on this? As far as we know it isn't on our credit reports either.

Ok I can DV them first that shouldn't be to much trouble and then maybe go for PFD. I am trying to work with BOA right now on our current account. We hadn't used it in a while and they got us with the 5.95 charge for monthly fee because we don't have direct dep. well that caused the acct to go neg. so I am going to call them tomorrow and see if I can get some love. I don't want to close the acct. but I didn't even think about the fee because we used to always have direct deposit. And I hate to pay $35.00 for that.

I got a settlement letter from them for an old acct. I had at Wachovia. I had closed the account but I had a check that was outstanding which caused me to overdraw. I started to send RJM a letter with full payment not the settlement amount and tell them what had happened and ask that they remove the CL from my CR.How easy is RJM to deal with? I guess I could call this a PFD. This is also showing up on my CR. We have a bank acct.now but because of this Walmart won't let us cash or write any check there and some other stores are the same way. So I would like to get it cleared up. This is the only thing on my Chex file.

I have a medical collection on my reports the CA is IC system. It is for a co-pay that I didn't pay and the bill didn't get forwarded when we moved. It is just $30 so I have no problem paying it but I would like to have it removed from my report. I was thinking a goodwill letter to the drs.office telling them that I am enclosing the full payment to them not the CA and in return I would like for them to remove it from the CA and have it removed from my report. I have read over some of the letters but I am confused on just which way to go with this.

I'm a coupon using fanatic. If you want to learn how to use coupons for items you actually use and where to find the deals. Check out a site that will help you for FREE. I learned everything from them. I get many many items for free. Everything they do is totally legal and you will see that the other people there really do check out things to make sure people don't post stuff that isn't legal. The site is www.couponforum.com I think you will be totally surprised at just how easy it is to use coupons and get items that you can use. My biggest savings was I got 346 cans of canned dog food for $34.xx which was just the tax.

Oh I thought they were the same I thought an Amex was an Amex card I didn't know there was a difference. As for giving them checking info. it still scares me not only on here but other places I have heard horror stories of places drafting for way more than the agreed apon amount.

Ok I have a question about this. We just did this for AMX( BofA American Express) with a $1600 bal. that we fell behind on. They said they had 2 programs 1 was for 60 months and the other was just 4 payments. What we agreed apon was the 4 month thing. We have to make 4 payments on X date for 4 months stright in a row. The will waive the over the limit fees,late charges and reduce our interest to 7.9. BUT they will close the account. I asked why and they said because it was considered late,over the limit,and a high risk so at their descretion they were closing the account. The only thing I am not sure about is this, they said that they would update our record at the CRAs to show paying as promised after the 4th payment. Since it is now showing 90 days late. Will this help my credit? Or will it still show as a baddie? I also refused to give them my banking account information since after reading here that places can be dishonest and take out more than they are suppose to. So I have a pre=paid money card from Walmart and they will do the first 3 bill pays for free and the others are only .88 the company that they use is one that the bill pay thing will electronically pay so I will just make sure to send it in as promised and that way they don't have access to my entire funds. The company they use is called FIA card services.

Since I haven't received any late notices or default letters and only got the 1 phone call I am not sure we will hear anymore from them but who knows. Tomorrow I am sending in a complaint to the FTC,and the atty General of AK and SC. I am also sending the information to the board of PIs in GA. I would send something to Credit Cars but I am totally lost on how to word it and I am not even sure I should.

The default occured afterwards. The car was bought in Oct. 2007 it was repaired 2 times for transmission issues. In March 2008 we paid almost $2000 to have it repaired out of our pocket (I still have reciepts) to have the tranny repaired and totally rebuilt. We figured that would be the end of it. and we bought the auto because it was 4x4 and large and where we are in AK you need 4x4. So at the end of April the fly wheel went out again in the tranny,we repaired it,in May it went out again we repaired it. We contacted the car place and they were suppose to send us a new contract showing a discount since we had spent so much on repairs and for the simple fact we were so far away it would cost them so much to come get it if we defaulted. No contract every came,I called the manager 12 times during June,July each time I was told that a new contract was on its way and not to send a payment. The contract never came and in August the auto went down again. It was sitting on the side of the road and we had it towed to the first place we came to (towing is very expensive here) we had a mechanic come out and look at it. He said based on the info given and repair history something was bent and the tranny and possibly engine would need to be replaced. He also told us that the engine was for a stright drive truck and we had an automatic SUV and said that could be part of the trouble. We then said the heck with it because the ball park range in cost he was giving us was about $4000 give or take some. We called and sent a letter this time telling them to pick up the auto and never got any response. We hadn't received any contact from them until Dec. when we got the Privacy notice. And then the other day when this so called investagator called. Had we known that after the total rebuild on it that it was going to be more problems we would've left it sitting on their door for sure.
