  1. Did you have anything useful to add? How about the fact that you have a BK7 listed in your signature that was awaiting discharge. Very clearly you are seeking to take steps to avoid the lender realizing that a purchase is being made for a person who otherwise would not have qualified AND for a purchaser who is apparently seeking to avoid the disclosure of the purchase to the Bankruptcy Court. If you have funds from which a purchase of a vehicle can be made, then you have funds that are sufficient to require a conversion to BK13. If you truly think there is nothing wrong with what you propose to do, then you should have ABSOLUTELY ZERO problems asking the Court and your BK Trustee whether the purchase is permissible... Oh goodie, another stab at Shady. Who is next? Trustee said I could keep my tax return money. Vehicle was purchased with tax return money. Hardly qualifies me for a CH13 conversion. Don't act like you know all of the details of my situation because you OBVIOUSLY do not. Thanks. I feel the love from a select few who ALWAYS seem to have something negative to say towards me.   4. I'm not sure if you know this, but when you received your "member packet" you should have got a coupon for the free shredder that you have to mail in if you really want the shredder. Dang! THAT'S why I never got mine! Haha sorry buddy. Don't worry though, you're not missing anything. It was good for about 30 seconds of entertainment. I had to put a stamp on the envelope so I'm out that much.
  5. *sigh* It is fraud if the loan agreement prohibits it and you do it anyway. Outside of that it isn't fraud. Marv says certain of his contracts prohibit it, therefore he won't knowingly approve such a sale because he'd be committing fraud. That doesn't mean that it's always fraud. It depends on what's in your finance agreement. Fair enough. It probably wasn't an issue for MY lender. I just don't like being accused of fraud or being told I've committed a crime when I'm pretty sure that's not the case. Some people like to think that if one lender prohibits it, they all do.
  6. Where in the world did you read my loan was denied? I'm not even sure why this thread turned into a discussion about my loan anyways or why people keep trying to call a staw purchase "fraud". If it were in the terms somewhere, I must have missed it and the finance manager, dealership manager and salesman must have missed it, too. Please, if we are going to call a straw purchase a "fraudulant" purchase, PLEASE PLEASE PLEASE post a reference link that backs that statement. I'm more than happy to read any links you can supply to back these statements. It's funny how I'm being attacked by people with nonstops insults and snide remarks and I am the one with the "attitude" ?????????????????????????????????? Unreal........   7. I actually got a decent loan with HSBC years ago. The APR was 12.95% and I had several CA's and CO's on my reports.

  11. Your reading comprehension really needs work. If I buy a car, and I make the payments, I can let whoever I want drive it, and that is not a straw purchase. A parent can make car payments and let a child drive their car. If I buy a car, and title it in my name, and I make the payments, that is fine, regardless if it's me or any other random person driving it. If I buy a car, knowing that YOU will be making the payments, that is a straw purchase. This would be buying a car, titling it in my name, but YOU are sending them money and I have no intention of paying for this loan. This has been explained to you umpteen times now, and as far as talking out of anyone's "@$$" the only one here doing that is you. I am quite sure marv would reprimand me if I was in fact conducting myself improperly. I cited BofA's contract a an example of a finance contract where it DOES appear in the fine print. You apparently don't believe it appears on any contracts when in fact, I cited a lender where it does appear. I really do not care who "your" loan is financed with, in fact I care very little about your situation at all beyond finding it incredibly amusing that you're STILL talking about this and STILL indignant because some people on a random internet forum told you that you did something bad Still mad that you've been proven wrong? Please, find me a case where someone has been convicted of a crime by purchasing a car for their loved one. PLEASE. I've explained to you SEVERAL times that this vehicle is parked in OUR garage, checks are written out of OUR account(she even writes the checks if you must know ), and she even drives the damn truck from time to time. When have I ever said I would be the only one making the payments???? Why aren't you understanding this???? TELL ME WHERE THE "CRIME" IS BEING COMMITTED.   14. Apples to oranges. If you're making a straw purchase in order to scam the bank out of money I would imagine you would be subject to some criminal charges. I've searched and searched and can't find a case where a bank/lender pressed charges on an account holder for purchasing a vehicle for his/her loved one. Unless of course the deal went bad and the bank went after them for anything they could to try to get their money back. Banks have been known to go after authorized users for defaulted credit cards, but that doesn't mean it's illegal or fraudulant to have an authorized user on your credit card. It's strange that some people say it's perfectly fine for a parent to buy a vehicle for a minor child to drive, but a a girlfriend can't buy a vehicle for her boyfriend to drive. Why are we calling one "fraud" and "illegal" and not the other? Can a wife buy a vehicle for her husband?? Can a husband buy a vehicle for his wife?? When I made my purchase, the salesman, the dealership manager and the finance manager knew EXACTLY what we were doing and they never mentioned a word about anything being out of line about the deal. If they knew this could be considered "fraud" or "illegal" in some way....shouldn't they have said something??? Or did they not say anything because it's a perfectly acceptable situation that they deal with on a daily basis?

I also get the sense that you're a little indignant that you have been called out for blatantly throwing misinformation around these forums(talking out of your @$$) and now your butthurt that you've aptly named yourself executer or misinformation. We're so proud of you. My loan is not financed with BofA, so once again, please stop spreading misinformation about subjects you obviously know NOTHING about. Even if a bank(for some crazy and wild reason)would request a loan to be paid in full, doesn't mean they will get it. It would most likely mean the loan couldn't be paid, the vehicle would be repo'd and sold for a fraction of what is owed and they would lose a CONSIDERABLE amount of money on the deal. Biting their nose to spite their face? Yes, I think so. Next time you want to throw misinformation around about subjects you know nothing about, do it in someone elses thread. Thanks.
