  1. They've tried 4 times to have the dismissal set aside and the court has said no, it stands. 18 months, 4 court appearances, endless rebuttals but we've won them all. They've surpassed in time spent the $1k they accuse us of owing. And they had no documentation, pretty bad for a multi national bank. I asked for the discovery before we went to trial. And got a one-page quickbooks printout. I made one for them too. Because anyone can print this stuff out, right? I've thought about talking to a NACA lawyer to find out if they've crossed a line. It is almost court based harassment. We are their only loss in our area.

  3. Hi everyone, it's been a while. My hubby was sued by Barclays via Erskine Fleischer for a CC. We won with prejudice because they did not show. Barclay's said that Erskine was just their representation, they have not assigned the debt to anyone so it is the OC. This happened 3/2011. In 07/2011 they made every excuse possible to reverse the decision. Went to court again. Decision stood. They've tried 4 times to get the court to overturn the verdict since. Today I pull hubby's credit, everything is still on there as deliquent account. But they've pulled his credit in April 2012. This is non-pp, right? We went to court and due to their bad judgement (they said they forgot they had court that day) we don't owe them. They can't sue us again for it. So if they sold the account, that would be double jeopardy. Thanks
  4. It was quite common back in the late 1800's and early 1900's to have photos of the dead (pre-burial). I cannot remember the name of them delirogue or something like it. I looked it up on wikipedia because I recently inherited my husband's family photos some going back to civil war times. And among them are some death photos. Its just not a common practice or accepted in some parts of our society. To each their own. But remember, everyone grieves differently.
  5. I'll admit it - I worked at Limited Too. Our store was intertwined with the Limited next door, we had a small wall and a few clothes racks that separated us. We could ring up their stuff as well. At the store I was at the sales lead was under the asst. manager. But it was just a $1 or $2 above min wage. The big $$ was the store manager because of the bonuses she got for store performance. Mostly everyone worked there only for the discount which was 40% off reg priced stuff and 30% off sales priced. But based on our hours we could only by so much stuff per month and they kept it in a big binder. Back then we didn't have a discount card but they may have one now. We got immediate discounts at Limited and Limited Too. Once a quarter we got equal discounts at Victoria's Secret, Bath and Body Works, Abercrombie, etc. That was the best. I eventually moved on and went to Pottery Barn and made a little bit more per hour with less stress - the perfectionism at Limited was crazy - equal spacing between hangers. I mean borderline OCD!! We could be there for up to 2 hours after closing just rearranging clothes. Retail pays like crap, and the hours suck. But the discounts are the perk that keeps you there. My hubby made me quit Pottery Barn when I was bringing home less pay than I was spending. Good luck! Negotiate on your pay, you are going in with experience.

  8. I can give you one equal to that, local to me is a middle school and residential neighborhood all built on a former bombing range. They are finding bombs buried around the school on a weekly basis. No one disclosed the information, greedy developer. Just a week ago, the Army Corps of Engineers declared that all the bombs were removed from the school's open areas, built atop the western fringe of a 12,483-acre bombing range. "Every day I come here is an absolute nightmare," said the woman, who in order to protect her daughter didn't want to be named. Nancy Stitch, a Corps spokeswoman, said: "We say there is no way we could have known it was there. . . . We stand by our previous statements that the school ground is safe." During the past five months, more than 100 munitions containing live explosives as well as 14 tons of bomb debris have been removed from school property. "The bottom line is that we're standing by the Army Corps assertion that the property that is under our control is safe," said school-district spokesman Dylan Thomas. "Their job is to rebuild the track area from their excavation. They have not yet turned over that property." Lisa Langan, who has a son at Odyssey, said her confidence is shaken. "We thought everything was all right, but now this," she said. "I'm worried and I just want this all to be done and over." Rowena Maandig said she isn't worried at all and that her two children are perfectly safe at school. "The kids are fine," she said. "The school is doing everything they need to keep them safe." The Corps has spent about $1 million in its cleanup efforts at Odyssey and some other properties on or near the former bombing range. Most of that money was spent on hiring a private munitions company from the Tampa area, USA Environmental Inc. A subcontractor for Bentley Striping of Crystal River, identified by a co-worker as Raymond Skuta of Floral City, was repairing the school's track-and-field area when he found a piece of a phosphorus bomb near the long jump's landing pit Sunday afternoon. Accounts vary as to what happened. Corps officials say Skuta picked up the 6-inch rusted cylinder and scratched at it with a knife. Others say Skuta hit the item with a rake or a shovel. Skuta couldn't be reached for comment Monday. Corps officials said that it was the nose of an already-exploded phosphorus bomb that still had some of the highly flammable element inside even after 60 years underground. The white phosphorus ignites spontaneously when exposed to air. Corps spokeswoman Amanda Ellison said the workers buried the object and unearthed it again after 30 minutes. "It did flame and smoke again," she said. Skuta breathed in some of the smoke and as a precaution was examined at Orlando Regional Medical Center, then was released. The contractors will return to the school this weekend and scan for any additional munitions. A construction fence was put around the area where the bomb fragment was found, said Frank Kruppenbacher, the school-district's general counsel. Kruppenbacher said he isn't going to simply take the Corps' word that the property is safe when it is returned to the school's control. "They're not simply going to say everything's OK and we open it back up," he said. "I want it all in writing, and I don't want there to be any loopholes. We want to know if there are any limitations."
  9. For 2007? The deadline isnt' until the end of Jan. He may still get it. They already filed with H & R Block. In fact, she just called to say she was on the way to pick up they're rapid refund check. I told her to put the check into savings and file an amended return.
  10. Let me clarify my post. He received $25k in pay outs and only has ~ $5k in deductions. That is what he is claiming is a wash. They want to buy a house this year - they're credit score is under 450. They have 3 judgements against them. 3 evictions. They've got a lot of baddies on the reports. They got a credit card last year, co-signed by one of their parents and its already been charged off now. They let me see their reports when they went to go buy a house. They want me to help them repair it. I won't do it. They just don't want to be responsible. I guess its a moral issue. I told them that they can't buy a house with an IRS judgement against them.
  11. I am just curious. I have some friends, a married couple with a baby and another on the way. He worked full time part of the year (2007) as an independent contractor. He had also worked like this the last part of 2006. To take this job he had open a corporation. Last night she bragged that they went to do their taxes and they didn't file his 1099 because he never received one . He estimated he earned over $25k. But then said it was a wash because he had enough expenses to write it all off (only $5k maybe). They've moved a bunch and this just maybe the reason he didn't get the 1099. How long until the IRS catches up with them? I tried to tell them that the IRS is going to roast them when they do get caught. I can't imagine the company he worked for not sending out 1099s. Anyone got any advice I can try to pound into these numbskulls? I warned and warned them but....
  12. You will not be eligible for federal financial aid if you have already obtained a Bachelors degree. You're better off just taking the core classes (Accounting 1, 2, etc) and using them to break into accounting.
  13. Have you ever tried the noodle "nests"? They essentially are spaghetti noodles or angel hair (I can't remember which one) molded into a bird nest looking thing. These are nice long noodles too and can easily fit them in a sauce pan. They make it easy for portioning (one per person) and give really pretty presentation too.
  14. Wow! And good for her parents (Lisa and Lenny), we've never heard any divorce craziness from them, kept her out of the spotlight and she hasn't gone the typical Hollywood wildchild. I love on Lenny's song to her "Flowers for Zoe". Lenny *yummy*.
