  1. That's what I was leaning towards, so thanks for the push. They are valid, should have come off a couple of months ago. We'll see if CFPB can get that ball rolling. Regarding the mortgage app, excellent suggestion. Inevitably they will show up at the 9th hour. I 'think' I have them all handled, but you know how those things go.
  2. Hi guys, Back on the dispute bandwagon after nearly a year off. I was getting so frustrated and I had to walk away for a while, regroup and start fresh. Currently, I'm having some issues with Experian (insert loud audience-wide gasp here). I submitted a written dispute, hand written, via CMRR, all the usual protocol. I receive a response that three of the items would not be investigated again because they'd processed a dispute previously, blah blah blah. I then received a second letter, along with updated credit report that said "Other items disputed are not currently displaying on your personal credit report." Hmmm, well thats interesting since the updated report they sent included ALL of the additional items I disputed. Fast forward a couple of days, I sent another letter pointing out their mistake, a copy of the original letter with highlighted items still outstanding and highlighted those same items in the updated CR. Six days later, I receive a response from them with updated credit file that, once again, says "Other items disputed are not currently display8ing on your personal credit report." A review of the updated report shows the contrary. So, what's the deal here? Are they not reading my letter? I'm really frustrated because the majority of the items I'm disputing are past the statute of limitations based on DOFD. I checked again this morning and they are STILL on the report, so their notion is completely invalid. I don't want to continue to send them letters that say the same thing and receive the same response. Of course, I tried to call them today (which I NEVER do) and address the issue, but they're closed for inclement weather. Anyone have any thoughts? Would complain to CFPB be in order at this point? Any suggestions would be appreciated. The hubs and I are trying to go for mortgage pre approval and any of these outliers being deleted would help the outcome. Thanks guys!!

  4. No, I didn't dispute through the CRAs yet, but thats my next avenue (as in ASAP). Thank you for the info on indirect communication. I think that supports my position with the JDB.
  5. After a six month hiatus from credit repair...it was getting to be too much for me to handle and frustrations were kicking in. However, as it seems that JDB went on a selling rampage at the end of the year, I'm receiving all kinds of letters in the mail. But I'm digressing, here is my question: I recieved a monitoring alert that a new collection had been placed on my credit report(s) by Millenium Financial Group. The alert came through on 02/21/2013. I've never recieved a dunning letter from them, so I subsequently sent them a Texas style DV CMRRR, which was received by them on 02/28/2013. Yesterday, 03/06/2013, I received a FedEx letter from an 'attorney' in response to my letter to them. He is denying all of my allegations, of course, and states that: "MFG does not believe it has had any communication with you regarding the XYZ Account, thus, the obligation to send a letter providing you (among other things) notice of certain of your rights under the Fiar Debt Collection Practices Act has not been triggered. When MFG communication with credit bureaus regarding the XYZ Account this was not a communication with you, but, as noted, was with the credit burearus. Arguagbly, your letter to MFG could be judged as communication. Therefore with this letter you will find MFG's letter to you describing your right to dispute the debt." Am I wrong to believe that placement in my credit file can be considered 'initial communication'? It seems assanine to me that they can place something in your credit file and wait however long they want to actually send a dunning letter. Is there any support to my position that I can go back to him with? He, of course, included a dunning letter (dated 02/27/2013 - conveniently) with his letter to me, but if initial communication can be determined from 02/21/2013, he missed his window. Help??!!
  6. At least you're "important to them and they appreciate your business" hahaha...yeah whatever. I've tried this with them as well and received nearly identical letters...not only that, three or four at a time. I guess their printing department was working in overtime. It doesn't matter what I've said or how I've structured my letter, this is what I continue to get back. Wish I had better news for you. Maybe someone else will chime in. Just know, you're not alone with these salamanders.

  9. I had the exact same problem with Merrick/Geico being double posted. I tried disputing via mail and it remained. I NEVER call the CRA's, but I decided to on this one and finally got a rep on the phone one day and explained the situation, she pulled up my report, entered a dispute and recieved an updated notice in about a week that the 2nd one was gone. I realize yours is a little bit different situation, but for the double reporting that worked.
  10. Yes they continue to update the tradeline. Just in the last couple of weeks has it finally shown disputed. It's only on Experian and shows disputed by subscriber...is that me or the CA? Yes bonded (unfortunately), and they're a Texas CA - Financial Management & Assoc. In my opinion, they've never shown me that they own the alleged debt, they've provided me with a copy of the front and back of a check made out to the OC that they say was returned, but that's it. I'd say no on the threats, the guy is just hateful in his letters more than anything. No real attacks and zero phone calls. I don't remember EVER getting anything from them and DV'd them based on seeing on my credit report...not that matters really.

Oh, and I forgot to mention that I've been dealing with this since April - my last response to him was 08/27/2012 and included printouts of three or four months of credit reports where the account still wasn't reported as 'disputed'. Only the last couple of weeks has it shown disputed. He, of course, didn't acknowledge that in his response.
  12. Someone help me out here - what's the issue with the Collection Agency reporting 1 month term on my CR? It's updated every month to look like a new collection. Is there some verbaige I can throw at them about doing that and it being a violation or is that a CRA dispute I'm in Tx if it matters. And yes, I've DV'd this company three times now. They are trying to collect on a bounced check from five years ago. They sent me a copy of the check, front and back, and that's it. I haven't had an account with that bank in nearly that long, so there's no way to go back and get the bank to pull information for me. After they sent me a hardly legible copy of the check, I responded that that wasn't validation as the check wasn't made out to them, they haven't shown that they have a right to collect, the amount they're putting on my CR is more than what the check was for etc. The president is the one that keeps responding to my continued requests and he's just ugly and personalizes the letters, making me sound like I'm some kind of salamander. I had to re-write my last response to him several times to take the emotion out of it because I was absolutely FUMING. His latest response (yesterday) was that my correspondance continues to have many inconsistnecies and inaccuracies (yeah, whatever) and that they've given me a copy of the check, that I can provide them with bank documentation but other than that forget it. Is there anything more that I can do? This is LITERALLY a $70 account. I haven't gone BBB/Tx AG/FTC complaint route... Thanks!!
