Wait until you have word from the other CRAs, you MAY have to file an FTC complaint against Ex if the other 2 CRAs delete. Update for WhyChat: I have received word from all three CRAs. They each verified the account for a second time. Central Financial Control still has not sent me proof of services rendered or anything CURRENT from the OC accept some papers that I signed back in 2009. On top of all that as I said before the amount they claim I was charged is different from the amounts on my credit reports. -

Update for Why Chat After sending the medical DV to Central Financial Control and the follow up disputes to the CRAs, Central Financial Control has validated the debt. They provided copies of the contract that I signed and also the date of service, however, there is one thing not adding up. My credit reports and the initial response from CFC to the Medical DV said I owed 800 dollars. The validation paper work I just received states that I was given a discount by the hospital in the amount of 916.83 dollars, since I was uninsured at that time. Why Chat which amount do I pay? Also I am prepared to pay the OC with the Hipaa letter and bank money order. I will proceed after you respond to this post. Thank you. I don't think this is REAL "validation" as it apparently doesn't match on the figures. What do you mean by "copies of the contract you signed"?? Have you had any response from the CRAs to the follow up dispute?? What ever hapenned with the prior payment to the OC that wasn't deposited?? The paperwork they sent seems to be copies of a financial responsibility agreement. They did not send proof of services and the total amount in the letter they sent me is 116 more than what is showing up on my credit reports. They also listed the amount owed as 800 dollars in the initial response letter to my Med DV. Now all of a sudden they write back that the hospital gave me a discount of 916 bucks. I'm really confused. It does not seem to me that the what you received from them are copies of any CURRENT communication from the OC. It appears that they received a copy of your paperwork when they first obtained the account, however unless you received a RECENTLY DATED copy of SOME communication to them from the OC you can be sure that they have NO CURRENT RELATIONSHIP Experian has sent in a reply that seems to amount to a fraud alert. I never asked them for a fraud alert, so I'm wondering why they have done this. It seems they are reinvestigation the the collection, as my score has gone up, but no specific response to the follow up letter to them, just a fraud alert. No response as of yet from Transunion or CSC Services. I am really confused now. What's my next move???? Update for Why Chat: I received a response from Transunion. They sent me a frivolous dispute letter. I'm still waiting on a response from CSC Services. TU frequently says one thing and does another, check your TU report in another week, if the response from TU was quick they may have actually deleted. Update for WhyChat Just received written word from Experian. They have updated the account . CSC/ Equifax signed for my letter about a week after Transunion and Experian, so I expect word from them by next week. Central Financial Control is a beast! I'm still confused about the different amount that shows on my credit reports and the amount they claimed the OC charged me. They never sent me a list of services rendered. Just a paper that was signed by me they claim is a "contract" I almost wish they can prove a current relationship with the OC so I can deal with the OC right away...frustrated, but still hopeful and grateful for your help WhyChat. -

Thanks for the quick response. Remember I sent a generic dispute to the CRAs in the beginning before I found this site, luckily I did opt out because I had heard about it in another forum, but didn't delete old addresses. I'll send these out today and come back with more news. -

The lack of proper response from the reporting CAs together with the fact that the OC has no record of your account demonstrates that there is NO current business relationship between the OC and the reporting CA. I will be sending these out early tomorrow morning and I have copies of the DVs to send out to the CRAs once I get confirmation of delivery on the USPS site. I will come back here before I send the follow up disputes to the CRAs. Update for Why Chat I mailed out the DV to Central Financial Control and it was delivered this morning. I printed the confirmation and I am now ready to mail the follow up letters to the CRAs. I just have a few questions before I move on. 1) In the initial dispute to the CRAs when they verify an account with a CA do the CRAs give the CA your current address? I have yet to hear from the CA in my case. 2) When I disputed to Equifax I received a response from CSC Credit Services. Do I mail my follow up to them? 3) If the CRAs don't delete and I get no response from the CA, what would be my next move? 4) All of the CRAs have PO Box addresses. Do I send CMRR or just CM similar to when a CA has a PO Box? 5? CSC lists a confirmation #, TransUnion a file #, and Experian a report # on the verified reports they sent to me. Is it right to assume that all these are pretty much the same as a report #? -
Louisiana SOL and Unpaid Emergency Bill

Yes I was following the lady from Alaska thread and as you say everything is based on SOL. From what I read it seemed that as long as the CA did not have a current business relationship with the OC a suit would not be possible. It was also mentioned that since the lady moved from Alaska she couldn't be sued anyway. You may want to wait for Why Chat to respond or send him/her a PM. In my case the alleged debt is still within the SOL, so there is no way I would touch this unless I had the money to pay the debt, if validated. Check with Why Chat before you do anything. -

If you are not prepared to pay the OC, in the case a current business relationship is established with the CA then you should not bother starting the process at all. Wait until you have the money. I'm from Louisiana, but now live in Texas and the SOL here is four years. You can go to Why Chat's website and see a list of SOL for each state. I think you make a good point about not wanting to wake a sleeping giant. If you start the process and the debt is validated and a current business relationship is established with the OC then yes they could threaten to sue you, especially if the amount owed is very high. In that case if you had the money you could immediately pay the OC. I'm not sure, but having the money to pay any valid debt is the key to this whole process. If the OC still has your files and they cash your money order then the CA can't sue you at all, but you don't pay a dime to anyone unless the CA can validate the debt. I'm sure Why Chat could make things more clear if I said something in error. Most importantly get your money together first! Do a search on google. Type in Why Chat Hipaa letter program. You will find the SOL links on the site. -

Hello Why Chat. I want to ask one more question before I send out my DV letters today. All three CRAs provided the name of the OC in their letters but no other info is provided. No address, no dates of service only the name of the OC and the CA's name and address. Is this enough to send the Hipaa letter to the OC or should I continue with the DV letters as advised? The amount owed is also provided but there is no way I can know if this is true or not without proper validation. Did I answer my own question lol. Anyway I'm ready to go and have all my attention focused on resolving this. Thanks again. -

What exactly did you mean in your first post Did you sign any agreement with the reporting CA?? Are all these accounts valid HOSPITAL bills?? Thank you Why Chat. The first post when I referred to a PFD (Pay for delete) is related to a separate medical account. The CA in that case agreed to do a PFD and faxed me a signed letter with their company letterhead and a written agreement to delete the TL after payment. I have not signed anything.The account that you are helping me with is a different one altogether with a different CA that I have never contacted and to my knowledge has never contacted me, sorry to confuse you because I would have never called the first CA had I known what I know now. Neither collection has been validated by the CAs but I do know that I received medical treatment in 2009 before I had insurance. In the first case I saw the 500 plus collection on my TU and I panicked. I called the CA and settled for half of the bill, so this TL showed up as settled at that time. Then I called back and asked if I paid the total amount would they delete the neg TL and they said yes. I asked for a signed agreement faxed and they faxed it to me in 15 minutes. I sent the money order to them CM, but they didn't sign for it yet a notice was left on the door. During this entire time I was constantly researching ways to deal with collections, which lead me to you and this site. Basically I did all the wrong things in the first case and luckily found out about Hipaa process soon after I disputed the account that I am dealing with now. That is why I am on the back foot but I'm hopeful and prepared to to this the right way from now on. What do you advise in the first case? I think my money order is still at the post office in California. I'm not even sure if CAs in Cali can collect debt in Texas legally. Wish I would have found this site 2 months ago Well, if you can, get a trace on the CMRR mail and see if you can get it returned to you or try to cancel the money order and get a refund. Did you include this account in your initial dispute to the CRAs?? It is more than likely that their mail is being forwarded to another address, RR mail is not forwarded. I did not include that account in the initial dispute. I will call the post office 1-800 # and try to get it returned. Should I start the Hipaa process on that account once I have the money order back in hand, or should I wait until I'm done with the account I'm working on now? -
Thanks Marv. I'm in the process of dealing with the collection accounts via the Hipaa process those are holding my scores down. Won't go for financing until that's resolved. Thanks again. A used car in the 20-23k range with low miles is also an option I'm considering.
