WhyChat, would this be a "bedbug" letter? If not, should I pay the OC with insert "a", and if I do, can the CA still pursue a judgement? Thank You so much for your help. Pay the OC with insert "a", once they are paid the CA would have no grounds to sue you. I paid the OC with separate official bank checks and found that they have not been cashed yet, but I did receive a letter from the OC stating: Dear Doinit, The purpose of this letter is to respond to the two letters with enclosed payments dated May 29, 2012. In these duplicate letters you state you feel that your rights under HIPAA and State Privacy rules have been violated because OC sent information to Credit Systems. The citations you note within the content of your letter refer to the same statutes we would act under. As a covered entity under HIPAA, we are permitted to select vendors to assist with our business operations which we do not provide which include credit and collections services. They act on our behalf. OC will process and work accounts to a certain point and then we seek the professional services of a vendor, in this cas, Credit Systems. The Credit Systems has been a "business associate" (as defined under the HIPAA regulations) of ours since 2003. When the HIPAA rules went into place we put into place a signed business associate agreement. Your letter states we did not have a "permissible business purpose" to disclosing your information. I am in disagreement. The permissible business purpose is for the collection of payment of services rendered. It is within HIPAA rules, specifically 45 CFR 164.501 which defines payment that permits us to use collection agencies. Within that definition itself of "payment" it includes collection services. It further states, "Obtaining information about the location of the individual is a routine activity to facilitate the collection of amounts owed and the management of accounts receivable, and, therefor, would constitute a payment activity." So OC believes it is acting within permissible business purposes and has the necessary documentation in place assuring Credit Systems, as our business associate, handles information we provide in a lawful manner. The information we provide to their service to to perform further payment methods include your demographics, the service date, account number and dollars due us. No additional information about the purposes for services, care you received, diagnosis and the like is provided to them as it is not necessary in order for them to fulfill the services we contract from them. If the payment you included now render your account "paid", there will not be a need for OC to further disclose to Credit Systems, other than letting them know you're now at a "status" of paid.Prior to this, the account was still open and they were lawfully able to follow the processes for collection. I am not able to respond to your request to have Credit Systems to fully delete your information from their files. You will have to take that up directly with them. But as a matter of law, I believe that they will need to retain and document services which will include the information I noted above, as demonstration that they have rendered services on our behalf. As well, I believe also permitted by law this remains on your credit history for a specified period of time. It is my hope this addresses the concerns you have raised within your letter to us. At the conclusion of this writing, I am personally walking the checks enclosed to out cashier's office for posting to your account. Respectfully, XXXX XXXXX Director, Health Information (HIPAA Privacy official) If I am assuming correctly it will not be ok for Credit Systems to post anything to my account as it is paid.

And I conveniently received two detailed bills from the OC for the two different accounts that Credit Systems is reporting. The accounts are valid and the amounts are correct and match the CR, but the account numbers on the bills I received today are different than the ones on my CR's, and the bills came from an office that is in a different city than where the hospital is. PURSUING A JUDGMENT AGAINST YOU WILL RESULT IN CONSIDERABLE ADDED EXPENSE AND INCONVENIENCE. I think I have made my thread way to confusing, so I am going to try to sort it out as it stands right now. To start with I had 9 collections with 3 different CA's. 6 from State Collections - showing on TU EQ EX 2 from Credit Systems - showing on TU EQ, not showing on EX 1 from Finance Systems - showing on TU EQ EX I opted out, and didn't have to delete addresses. I got real CR's from all three. I sent WhyChat's CRA dispute letters to all three via CM. I have received the results back from each CRA: 6 from State Collections - TU deleted all 6, EX deleted one and 5 remain, EQ shows all 6 remaining 2 from Credit Systems - TU shows both remaining, EQ shows both remaining, EX doesn't show them 1 from Finance Systems - TU deleted, EQ shows it remaining, EX shows it remaining. I have only received validation from Finance Systems, and I am sending out payment to OC with insert a. I am a bit confused as to what to do now. Do I wait a while longer for the CA's to respond, or do I send the letters to the CA's now? Thank You to all who have helped me get this far. We have concluded with the information received, the account (s) is/are valid. We have updated the account (s) as disputed with the appropriate credit reporting agencies. It stated that 2 of the 9 disputed (CA Y) were verified. 7 of the 9 disputed (CA X and CA Z) were deleted. CA Z is the one you told me to pay the OC with insert A, and I will do that . This probably is a stupid question, and not my first, but how do I track a bank money order / cashiers check? Do I wait a reasonable amount of time, and then go to the issuing bank and ask them to track it? I received a response from EX concerning my dispute. Everything, except one with no balance remained on my CR. I kind of expected this after reading what others have experienced with EX. What I did find interesting though were two disclaimers that would IMO be aimed at people using the WhyChat method.The first is right on the front page of the dispute results and states "When a medical bill is seriously past due, the provider may use an internal collection department, hire an attorney or contract with a collection agency to collect the payments, and this information may be reported to us since it is a financial obligation. Once the payments have been collected, the account will display as "paid/collection" and may remain on the report for seven years. Because we cannot display certain medical information, it may appear in the name of the data furnisher, for example "Cancer Center." To prevent this, we mask the names of data furnishers that provide us medical payment history when we provide your information to others. This requirement does not extend to the payment history that the data furnisher provides us. Your payment history with this creditor will be displayed in reports to others. Sincerely, EX blah blah blah.. Disclaimer number two states "By law, we cannot disclose certain medical information (relating to physical, mental, or behavioral health or condition). Although we do not generally collect such information, it could appear in the name of the data furnisher (i.e. "Cancer Center") that reports your payment history to us. If so, those names display on your report, but on reports to others, they display only as MEDICAL PAYMENT DATA. Consumer statements included on your report at your request that contain medical information are disclosed to others." I haven't received anything from EQ about my dispute with them, and have only had one reply from a CA, and that one is being paid with the letter with insert a. This really can get to be a bit overwhelming with all the reports, and correspondence, but I have made files for each CRA, and I am keeping every bit of information concerning each in them. I am a bit concerned that I may not receive anything from the other reporting CA's, but will sit tight and wait a bit more.

I did receive a letter from TU stating that it had finished it's investigation of my dispute. It stated that 2 of the 9 disputed (CA Y) were verified. 7 of the 9 disputed (CA X and CA Z) were deleted. CA Z is the one you told me to pay the OC with insert A, and I will do that . This probably is a stupid question, and not my first, but how do I track a bank money order / cashiers check? Do I wait a reasonable amount of time, and then go to the issuing bank and ask them to track it?

I opted out, didn't need to delete addresses as I have lived here for 13 years.I got real CR's from TU, EX, and EQ. I sent the pre HIPAA disputes to all 3 CRA's (CM), and on checking via the back doors, found that TU deleted 7 of the 9 (CA's (X&Z). EX and EQ were investigating. I have not received anything from any of the CRA's, but today received a letter from CA (Z) that states : Creditor - XXX Pathologists Account Number - XXX Last Activity Date - XX/XX/2009 Principle/Balance - $104.56 Interest - $0.00 Account Balance - $104.56 Dear XXX, We have completed the investigation regarding the disputed account (s) above. We have concluded with the information received, the account (s) is/are valid. We have updated the account (s) as disputed with the appropriate credit reporting agencies. If you have any questions, please contact our office directly. Sincerely, Debt Collector (this is how they signed it) Does this show a valid working relationship between this CA and the OC? If not, what do I do next? Other than not communicate with the CA. I hope this isn't to confusing, but all of the CA's are local. If this were valid would TU have deleted it along with the other 6? I believe that Cap 1 still owned the account. I never received anything from any CA, and got statements from Cap 1. I don't know when / if it was charged off, but that it what it says on all my CR's, except for TU which deleted it along with some other medical collections I disputed. I will try to find the rule 5000 you talk about, but it sounds like it is to late for that anyway. I don't know if I should dispute that with EX, as it doesn't say that on my EQ CR.

Hi, I'm a bit confused by an item listed in my EX CR. It is for a CO by Cap1 that I PIF recently. The balance was $675.00 and I was still being billed by Cap1. I sent PIF as listed on the Cap1 statement I received in the mail on March 20, 2012 by Bank Money Order. Both TU and EQ are showing the account as paid with 0 balance, but EX is showing Status - Account Charge Off $292 written off Date Opened - 08/2005 Date of Status - 04/2007 Reported Since - 08/2005 Last Reported Date - 04/2012 Type - Credit Card Terms - N/A Monthly Payment - $0 Responsibility - Individual Credit Line - N/A High Balance - $675 Recent Balance - $0 Recent Payment - $0 Account closed at credit grantors request. How can they state that $292 was written off if I paid the total balance as listed on the statement I received from Cap1? Amy help/advice is gratefully appreciated
