If You Negotiated a Settlement for Less Than You Owed, Can the Creditor Sue You For the Balance? Yes! You need to read the following information carefully. Some collection agencies will agree to settle with you for far less than you owe and then turn around and hire another collection agency to collect the difference. However, in many states this is illegal. Once a creditor deposits or cashes your check, even if they strikes out the words "payment in full" and writes "I don't agree" on the check, they can't come after you for the balance.   2. today. I had already settled the debt with Zwicker & Associates back in July 2011 and received a letter that it has been settled and the client(citi) had been notified. Do you think Citibank sent my account out by mistake? Should I call Citibank to ask them to withdraw from the second debt collector? What should I do? I do not want to pay as I received the canceled debt 1099 already.
  3. today which I had already settled the citibank debt through Zwicker & Associates back Jun of 2011. So can Citi use another debt collector to come back for the balance. Debt was about $4200 and I settled $2500 or $2600 already. I also received a letter from Zwicker & Associates that the debt has been settled and they also notified the client which is Citibank. Can this be an error on Citibank side?

I received a letter from Zakheim & LaVrar today stating they are attempting to collect a debt that is owed to Citibank.na and that at this time no attorney with this firm has personally reviewed the particular circumstances of the account. I had already settled the Citibank debt through Zwicker and Associates and received a letter from Zwicker and Associates that the account has been settled in full and they have notified Citibank. My question is that can Citibank go after me again for settling the debt. I believe I paid over 50% of the debt. The debt was about $4200 and I settled the debt at $2500. My question is can Citibank sell the rest to another debt collector because I received a letter that the debt was settled again. Can i use the letter from Zwicker to prove to citibank I paid already?
