  1. I agree that at a minimum the balance should report $0. I'm wondering if there isn't a legal argument for not reporting the account at all since the 1099-C "cancels" the debt (in theory).
  2. There's been some discussion on this topic, but I'm not sure if there's a general consensus answer yet. In a situation where an OC lists an account as CO, the SOL expires and they eventually send you a 1099-C, is it still acceptable for the OC to list that account on your CR 'till the end of the standard 7yr reporting period?
  3. Update: Pulled my reports today and they are no longer listed. I have yet to dispute the listing or DV them. Hopefully that's that. Will update here if I get further contact from them. Got my FICO 10 points back!!
  4. JenniferinTN: I don't think this is a coincidence at all. I did fine one other example on the boards of this CA suddenly adding, then deleting an old account within a couple of days. Will keep checking for that. ding: Looks like a lot of people are using either DV/1-2 punch dispute or BBB. Will give it a few days, then try and figure out which way to go.
  5. I forgot to mention Enhanced Recovery is the CA and AT&T is the OC. Any/all suggestions appreciated.
  6. I've made a lot of progress thanks to help from this board and am well on my way to full recovery, however I just suffered an unexpected setback. I paid a CA for an old account in Dec 2011. The dollar amount was small and they weren't listing on any CRs at the time so I assumed that was the end of that. I pulled my CRs today and found that CA just listed this account (listed as paid/closed in Dec 2011). That cost me 10 much needed FICO points. The hit could have been much greater but still, I thought I was done with all CAs and was trying to maintain 0 CAs on my CRs. I know I shouldn't be shocked by the activity of a CA, but this seems truly odd. Is this type of thing more common than I realize?

  8. I decided to take a chance and call their credit bureau dept and request deletion since others have reported success with this method. I got a "it's not possible for us to have the CB delete before the 7 year period" response. Obviously inaccurate, but I didn't press it. I'll wait a couple more months and try the request in writing if they don't automatically delete.
  9. They backdated my Oasis tradeline without my asking (been in the program for a few months). I'm actually glad to get back in with them. I also understand the old lines have less impact as they age, but paid chargeoffs are still a major ding. There was at least one person who found that they deleted the orig lines after they entered Oasis, but It's clear they haven't been consistent.
  10. Some of you in the Amex Oasis program mentioned that they eventually deleted the original old Amex account listings once you were in the program. How long did this take, and did it happen automatically, or did you have to request deletion from Amex?

    *disclaimer* I'm not a lawyer and can't offer legal advice. The information I have based on two separate consumer lawyer consultations in NC is that the SOL is 3 years from the date of last payment. Keep in mind that SOL is only an affirmative defense against a lawsuit and will not necessarily stop a CA/JDB. My suggestion would be to tread lightly with items on your report that may be close to SOL and focus on older/clearly far outside SOL items first. I'd also suggest reading up on the nc consumer protection act of 2009.
  13. Anyone? I have a hunch the "no records" dispute referenced in the linked post will be fine, but I'm concerned about it getting treated as a "not mine" and getting the previously investigated stance from some CBs if a re-dispute is needed.
  14. Yup, that's what I was thinking. Just debating on including the C&D all phone communications in this letter. I'm pretty sure any account they have would be outside the SOL.
  15. I'm ready to send off an initial dispute for an OC listing that's outside the legal SOL for my state. The account was sold to a JDB Dec 2009 and the listing hasn't been updated since then.
